On 11th May 1988, the<br \/>\n\trespondent No.1-Corporation issued appointment order to the<br \/>\n\tpetitioner as a Pumpman in the pay-scale of Rs.800-1150.<br \/>\n\tThereafter, on 29th November 1996, the<br \/>\n\trespondent-Corporation published advertisement for the recruitment<br \/>\n\tto the post of Pumpman in the pay-scale of Rs.1150-1500. On 03rd<br \/>\n\tDecember 1996, the petitioner applied to the respondent No.1 asking<br \/>\n\tthe pay-scale of Rs.1150-1500 as a Pumpman. Though the other<br \/>\n\tsimilarly situated employees were given the pay-scale of<br \/>\n\tRs.1150-1500, the petitioner has not been granted the same. Hence,<br \/>\n\tthe present petition.\n<\/p>\n<p>During<br \/>\n\tthe course of hearing, Mr.R.M. Chhaya, learned advocate for the<br \/>\n\trespondent No.1, has submitted that this Court  has disposed of an<br \/>\n\tidentical petition i.e. Special Civil Application No.8946 of 1998<br \/>\n\tvide order dated 07th April 2010,  which deals with the<br \/>\n\tsimilar facts and the issue raised in the said petition are<br \/>\n\tidentical. Hence, the present petition may be disposed of<br \/>\n\taccordingly.\n<\/p>\n<p>It<br \/>\n\twould be beneficial to reproduce the said order dated 07th<br \/>\n\tApril 2010 passed in Special Civil Application No.8946 of 1998 inter<br \/>\n\talia as under :\n<\/p>\n<p> 2.0<br \/>\n\tThe case of the petitioner is that the petitioner was appointed as<br \/>\nPumpman in the Light Department in Ahmedabad Municipal Corporation on<br \/>\npay scale of Rs.800-1150 in pursuance of compromise arrived in<br \/>\nSpecial Civil Application No. 5199 of 1986 between Union and AMC. On<br \/>\n11.05.1988, respondent No.1- Corporation gave appointment order to<br \/>\nthe petitioner as a Pumpman in the pay scale of Rs. 800-1150. On<br \/>\n19.11.1996, respondent No. 1- Corporation gave advertisement in the<br \/>\ndaily newspaper  &#8216;Gujarat Samachar&#8217; for the recruitment of Pumpman in<br \/>\nthe pay scale of Rs. 1150-1500. On 03.12.1996, the petitioner applied<br \/>\nto respondent No. 1 asking pay scale of Rs. 1150-1500 as a Pumpman.<br \/>\nThe other similarly situated employees were given pay scale of Rs.<br \/>\n1150-1500 where there is discrimination against the petitioner.<br \/>\nHence, this petition.\n<\/p>\n<p>3.0<br \/>\n\tAs a result of hearing and perusal of the record and submission made<br \/>\nby learned advocate for the respondent that the petitioner was paid<br \/>\nthe pay scale  by consent terms. It is also stated that while merging<br \/>\nthe Gramp Panchayat in the Corporation the petitioner was employed in<br \/>\nthe Gram Panchayat. In that view of the matter,  no further order is<br \/>\nrequired to be passed in this petition. The petition stands disposed<br \/>\nof accordingly. Rule is discharged with no order as to costs. Interim<br \/>\nrelief, if any, stands vacated.\n<\/p>\n<p>In<br \/>\n\tview of aforesaid, when the issue involved in the present petition<br \/>\n\thas already been decided by this Court by way of above cited<br \/>\n\tdecision, in light of the same the present petition is required to<br \/>\n\tbe disposed of and<br \/>\n\tthe same is disposed of accordingly. As per the statement made by<br \/>\n\tthe learned advocate for the petitioner respondent No.1, the<br \/>\n\tpetitioner be paid the pay-scale as per the consent terms. The<br \/>\n\tparties to abide by the above cited decision. Rule is discharged<br \/>\n\twith no order as to costs.
