As the complainant did not pay the<br \/>\n\tinstalments, legal notices were sent to the complainant through<br \/>\n\tadvocate by Tata Motor Finance Ltd. Without clearing the loan<br \/>\n\tliability, the complainant sold the said vehicle  to accused No.1 by<br \/>\n\texecuting an agreement on 16-3-2010 without prior permission of the<br \/>\n\tFinance Company and forging the No Objection Certificate of Tata<br \/>\n\tMotor Finance and got  removed hypothecation from RC book from RTO,<br \/>\n\tBhuj.  However, a complaint was filed by the complainant implicating<br \/>\n\tthe Branch Manager, who was responsible for recovery of loan amount<br \/>\n\tas an accused No.2. Hence, present application for quashing the<br \/>\n\tcomplaint qua the  petitioner.\n<\/p>\n<p>Heard<br \/>\n\tlearned advocate, Mr.Devang J.Joshi for the petitioner,<br \/>\n\tMr.L.R.Pujari, learned APP for the respondent No.1 and learned<br \/>\n\tadvocate, Mr.Jitendra H.Singh for the respondent No.2.\n<\/p>\n<p>This<br \/>\n\tCourt has gone gone through the complaint in question and the<br \/>\n\tingredients therein. For the purpose of quashing of the complaint,<br \/>\n\twhat is required to be seen is whether complaint discloses the prima<br \/>\n\tfacie ingredients of offence or not and if it does not disclose the<br \/>\n\tingredients of the offence, complaint can be quashed.\n<\/p>\n<p>It<br \/>\n\tappears that the applicant is a Branch Manager of Tata Motor Finance<br \/>\n\tLtd. who is responsible for recovery of loan instalments from the<br \/>\n\tcomplainant, who has taken loan from Tata Motor Finance Ltd. and who<br \/>\n\tsold the vehicle to accused No.1 without paying the instalments and<br \/>\n\tforging the No Objection Certificate of Tata Motor Finance for<br \/>\n\tremoval of hypothecation from RC Book. It appears that the<br \/>\n\tpetitioner was seeking to recover the amount of instalments of loan<br \/>\n\ttaken by the complainant, hence, as a counter blast, present<br \/>\n\tcomplaint has been filed. No ingredients of offence alleged against<br \/>\n\tthe present petitioner is disclosed from the averments made in the<br \/>\n\tcomplaint. Hence, the complaint is required to be quashed qua the<br \/>\n\tapplicant.\n<\/p>\n<p>In<br \/>\n\tview of the above, complaint being Criminal Case No.13 of 2011 filed<br \/>\n\tbefore the Court of learned Judicial Magistrate (First Class),<br \/>\n\tGandhidham, Kachchh, is quashed and set aside qua the present<br \/>\n\tpetitioner.
