KRISHNAN, J.\n                   ...........................................\n                    M.A.C.A.NO.349 OF 2009\n                  .............................................\n             Dated this the 19th day of July, 2010.\n\n                         J U D G M E N T\n<\/pre>\n<p>     This is an appeal preferred against the award of the<\/p>\n<p>Claims Tribunal, Kozhikode in OP(MV)No.2050\/2003.                        The<\/p>\n<p>claimant, who is alleged to have sustained injuries in a road<\/p>\n<p>accident, moved an application for compensation and it has<\/p>\n<p>been dismissed for want of evidence and documents. The<\/p>\n<p>court   also   suspected        that      he      would        have submitted<\/p>\n<p>application before another Tribunal.<\/p>\n<p>     2. I feel that the methodology adopted by the court is<\/p>\n<p>absolutely incorrect and it has also to be stated that the<\/p>\n<p>claimant had been very negligent in prosecuting the matter.<\/p>\n<p>Therefore,   between the period 4th April, 2008 till today, the<\/p>\n<p>claimant shall not be granted any interest. I am inclined to<\/p>\n<p>give an opportunity and therefore the award under challenge<\/p>\n<p>is set aside and the matter is remitted back to the Tribunal<\/p>\n<p>with a direction to permit all concerned to produce<\/p>\n<p>documentary as well as oral evidence in support of their<\/p>\n<p>respective   contentions and then dispose of the matter in<\/p>\n<p>accordance with law. I make it clear that the claimant shall<\/p>\n<p><span class=\"hidden_text\">                             : 2 :<\/span><br \/>\nM.A.C.A.NO.349 OF 2009<\/p>\n<p>not be entitled to any interest from 4th April, 2008 till today<\/p>\n<p>i.e., 19.07.2010. Parties are directed to appear before the<\/p>\n<p>Tribunal on 04.09.2010.\n<\/p>\n<p>      Disposed of accordingly.\n<\/p>\n<p>                                  M.N.
