APP (DB) No.143 of 2011\n                          PANKAJ NIGAM @ SONU KUMAR\n                                       Versus\n                               THE STATE OF BIHAR\n                                      -----------\n<\/pre>\n<p>03\/   17th March 2011          Heard learned counsel for the appellants and learned<\/p>\n<p>                        counsel for State in both these appeals for the purpose of<\/p>\n<p>                        deciding whether bail should be granted to the appellants or<\/p>\n<p>                        not who have been convicted under the provisions of the<\/p>\n<p>                        NDPS Act by a common judgment under appeal. Lower<\/p>\n<p>                        court records are available.\n<\/p>\n<p>                               So far as appellant Pankaj Nigam @ Sonu Kumar is<\/p>\n<p>                        concerned the prosecution case is categorical that on his<\/p>\n<p>                        confession and disclosure made to Inspector Ramakant<\/p>\n<p>                        Prasad, PW-1, a raid was made at various houses in village-<\/p>\n<p>                        Jethuli leading to recovery of 780 Kilograms of Ganja in<\/p>\n<p>                        total. The quantity is much higher than the commercial<\/p>\n<p>                        quantity. The prayer of this appellant for bail is rejected.<\/p>\n<p>                               In respect of other appellant i.e., Rudal Yadav the<\/p>\n<p>                        submission is that the evidence is deficient to connect him<\/p>\n<p>                        with the crime under the NDPS Act. However, learned<\/p>\n<p>                        counsel for the State submits that inculpatory statement of<\/p>\n<p>                        co-accused, Pankaj @ Sonu fully involves this appellant,<br \/>\n<span class=\"hidden_text\">                        2<\/span><\/p>\n<p>         Rudal Yadav and according to PW-1 when the house of one<\/p>\n<p>         Doman was raided, three persons started fleeing away from<\/p>\n<p>         that place but one of them was apprehended and he was<\/p>\n<p>         Rudal Yadav. 90 Kilograms of Ganja was recovered from<\/p>\n<p>         that house. According to learned counsel for the State<\/p>\n<p>         Section-53A of the NDPS Act makes statement of co-<\/p>\n<p>         accused, Pankaj @ Sonu relevant and admissible regardless<\/p>\n<p>         of bar of Section-25 and 26 of the Indian Evidence Act.<\/p>\n<p>                The facts proved by the prosecution show an<\/p>\n<p>         organized crime dealing with contraband Ganja and<\/p>\n<p>         recovery of a huge amount of 780 Kilograms of Ganja.<\/p>\n<p>                In the facts of the case, we are not inclined to grant<\/p>\n<p>         bail.
