{"id":202975,"date":"2011-10-25T00:00:00","date_gmt":"2011-10-24T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/anil-kumar-saraogi-vs-the-state-of-bihar-anr-on-25-october-2011"},"modified":"2016-02-22T14:13:25","modified_gmt":"2016-02-22T08:43:25","slug":"anil-kumar-saraogi-vs-the-state-of-bihar-anr-on-25-october-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/anil-kumar-saraogi-vs-the-state-of-bihar-anr-on-25-october-2011","title":{"rendered":"Anil Kumar Saraogi vs The State Of Bihar &amp; Anr on 25 October, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Anil Kumar Saraogi vs The State Of Bihar &amp; Anr on 25 October, 2011<\/div>\n<pre>                   IN THE HIGH COURT OF JUDICATURE AT PATNA\n                         Criminal Miscellaneous No.8867 of 2008\n                                    Anil Kumar Saraogi\n                                            Versus\n                               The State Of Bihar &amp; Anr\n                               ----------------------------------\n<\/pre>\n<p>6   25-10-2011             This    application           has    been     filed      for<\/p>\n<p>                 quashing the order dated 31.10.2006 passed by<\/p>\n<p>                 Sri A.K.Singh, Judicial Magistrate, 1st Class,<\/p>\n<p>                 Patna     in     Complaint        Case        No.    2882(C)\/2006<\/p>\n<p>                 whereby he took cognizance under sections 406<\/p>\n<p>                 and 420 IPC against petitioner.\n<\/p>\n<p>                           Heard counsel for the parties.\n<\/p>\n<p>                           As per allegation, petitioner is said<\/p>\n<p>                 shareholder       of      200     shares        of      Jaiprakash<\/p>\n<p>                 Industries Ltd., having share certificate no.<\/p>\n<p>                 16691     bearing      Registered         Folio        no.      34967,<\/p>\n<p>                 having Distinctive no. 48894008 to 48804107 for<\/p>\n<p>                 100      shares     and      Certificate             No.        48862,<\/p>\n<p>                 Registered Folio no. 34967 having Distinctive<\/p>\n<p>                 no. 52111108 to 52111207 for 100 shares.<\/p>\n<p>                           Petitioner       sold     his       shares       in   share<\/p>\n<p>                 market     and    complainant           purchased        the     said<\/p>\n<p>                 shares     through     his       share        broker     Ramesh      &amp;<\/p>\n<p>                 Company and after payment of full consideration<\/p>\n<p>                 money, got the delivery of all the shares vide<\/p>\n<p>                 Bill      No.      RC77         dated         9.3.1995.         After<\/p>\n<p>                 amalgamation of Jaiprakash Industries Limited<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>with Jaipee Cement limited, new name came in<\/p>\n<p>existence as Jai Prakash Associates Limited.<\/p>\n<p>Shares were forwarded for effecting transfer in<\/p>\n<p>name of complainant opposite party no.2 and was<\/p>\n<p>intimated that shares already were dispatched<\/p>\n<p>to petitioner (original transferor).<\/p>\n<p>           Thereafter             several          correspondences<\/p>\n<p>(requests)      were       made       to    Company      as   well       as<\/p>\n<p>petitioner      but        without         response.      Then      legal<\/p>\n<p>notice was sent to Jai Prakash Industries and<\/p>\n<p>petitioner       at       his     Kolkata       address.           It    is<\/p>\n<p>specifically          alleged          that        the     price          of<\/p>\n<p>complainant&#8217;s             share       is     misappropriated             by<\/p>\n<p>petitioner.      Submission             is    that       shares         were<\/p>\n<p>purchased by complainant- opposite party no.2<\/p>\n<p>in the year 1995 and initiative was taken only<\/p>\n<p>in the year 2005 for effecting transfer in his<\/p>\n<p>name.   Petitioner          is       denying his identity                at<\/p>\n<p>Kolkata address with further submission that<\/p>\n<p>this    Court     has           no     jurisdiction           to        take<\/p>\n<p>cognizance.\n<\/p>\n<p>           There is no limitation for effecting<\/p>\n<p>transfer    of    shares             which    is    opened         to    be<\/p>\n<p>purchased anywhere at any time if are sold.<\/p>\n<p>Share is not purchased at Ahmedabad or Kolkata<\/p>\n<p>and every correspondence is made from Patna.<br \/>\n<span class=\"hidden_text\">                      3<\/span><\/p>\n<p>     So, this is well within the jurisdiction of the<\/p>\n<p>     Court at Patna.\n<\/p>\n<p>             Petitioner has been identified by his<\/p>\n<p>     both addresses that of Ahmedabad and Kolkata<\/p>\n<p>     that   also   does   not     justify    to   doubt   the<\/p>\n<p>     prosecution case.\n<\/p>\n<p>             I find no infirmity in the order dated<\/p>\n<p>     31.10.2006    taking       cognizance    against     the<\/p>\n<p>     petitioner by the court below.
