Heard   counsel    for    the     petitioner   and   the<\/p>\n<p>            respondents.\n<\/p>\n<p>                   I.A.No.5957   of     2010     has     been   filed     for<\/p>\n<p>            substitution of the original petitioner who is said to<\/p>\n<p>            have been deceased on 8.12.2002 by his legal heirs as<\/p>\n<p>            stated in para-2 of the application.<\/p>\n<p>                  Mr. Choubey, appearing for the respondents submits<\/p>\n<p>            that he is not in a position to oppose the substitution<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>application in view of the order of the Civil Court that<\/p>\n<p>the Trust was private in nature.<\/p>\n<p>    The      substitution        application           is     allowed.           The<\/p>\n<p>deceased petitioner is permitted to be substituted by his<\/p>\n<p>legal heirs as stated in para-2 of the interlocutory<\/p>\n<p>application.\n<\/p>\n<p>    Mr.      Choubey,     appearing         for    the         Bihar        State<\/p>\n<p>Religious     Trust     Board,      fairly    submits           that        in    a<\/p>\n<p>subsequent    suit    filed    by   the     petitioner         it     has    been<\/p>\n<p>declared to be a private Trust to which the provisions of<\/p>\n<p>Hindu Religious Trust Act does not apply.<\/p>\n<p>        In that view of the matter, the impugned orders<\/p>\n<p>dated   30.4.1988,      29.9.1989     and    1.4.1992          automatically<\/p>\n<p>stand vitiated as being without jurisdiction. We do not<\/p>\n<p>therefore    consider     it     necessary        to        discuss    further<\/p>\n<p>issues.
