No. 4716 of 2008\n               ==================\n          Dated this the 4th day of June, 2009.\n\n                          O R D E R\n<\/pre>\n<p>    Complainant in C.C.No.230\/2006 filed this petition<\/p>\n<p>under Section 482 of Code of Criminal Procedure to quash<\/p>\n<p>Annexure V and VI orders passed by Additional Chief<\/p>\n<p>Judicial Magistrate, Thalassery.    Annexure V order was<\/p>\n<p>passed in CMP No.3139\/2008 filed under Section 311 of<\/p>\n<p>Code of Criminal Procedure to receive documents at the<\/p>\n<p>stage of posting the case for cross-examination of<\/p>\n<p>prosecution witnesses, after framing of charge under<\/p>\n<p>Section 246 of Code of Criminal Procedure. Annexure VI<\/p>\n<p>order was passed in CMP No.3140\/2008, a petition filed<\/p>\n<p>under Section 91 of Code of Criminal Procedure to direct<\/p>\n<p>the accused to produce documents. Both the petitions were<\/p>\n<p>dismissed.\n<\/p>\n<p>    2.   Learned Counsel appearing for petitioner and<\/p>\n<p>learned Public Prosecutor were heard.      There was no<\/p>\n<p>representation for first respondent.\n<\/p>\n<p>Crl.M.C.No.4716\/2008<br \/>\n<span class=\"hidden_text\">                             -2-<\/span><\/p>\n<p>      3.    CMP No.3139\/2008 was filed under Section 311 of<\/p>\n<p>Code     of    Criminal Procedure  to   receive    additional<\/p>\n<p>documents, which were not produced at the time when<\/p>\n<p>evidence of prosecution witnesses were recorded as<\/p>\n<p>provided under Section 244 of Code of Criminal Procedure.<\/p>\n<p>Case of the petitioner in Annexure II petition is that earlier<\/p>\n<p>the accused had undertaken to produce relevant documents<\/p>\n<p>and accounts before the Court, but he deliberately did not<\/p>\n<p>produce them as undertaken and later he destroyed some<\/p>\n<p>documents and created some false documents and the<\/p>\n<p>documents produced along with the petition are necessary<\/p>\n<p>to prove the prosecution case and those documents were<\/p>\n<p>omitted to be produced earlier and hence they are to be<\/p>\n<p>received. Under Annexure V order, Magistrate dismissed<\/p>\n<p>the petition holding that those documents were not<\/p>\n<p>produced at the time when evidence was recorded under<\/p>\n<p>Section 244 of Code of Criminal Procedure and when the<\/p>\n<p>case is posted for cross-examination of prosecution<\/p>\n<p>witnesses under Section 246(5), the documents cannot be<\/p>\n<p>received and as it would cause prejudice to the Counsel.<\/p>\n<p>Crl.M.C.No.4716\/2008<br \/>\n<span class=\"hidden_text\">                              -3-<\/span><\/p>\n<p>Learned Counsel appearing for petitioner pointed out that<\/p>\n<p>the documents had earlier agreed to be produced by the<\/p>\n<p>accused but he deliberately did not produce the documents<\/p>\n<p>and those documents are relevant and necessary to decide<\/p>\n<p>the question involved in the case and in such circumstances<\/p>\n<p>the documents should have been received in evidence.<\/p>\n<p>      4.    Section 311 of Code of Criminal Procedure<\/p>\n<p>enables the Magistrate at any stage of trial to summon any<\/p>\n<p>person as a witness and examine, if it appears to be<\/p>\n<p>essential to the just decision of the case. While dismissing<\/p>\n<p>the application in Annexure V order, the Magistrate did not<\/p>\n<p>consider the question whether the documents are essential<\/p>\n<p>for a just decision of the case. The petition was dismissed<\/p>\n<p>on technical reasons stating that documents were not<\/p>\n<p>produced earlier and at the stage of cross-examination of<\/p>\n<p>prosecution witnesses under Section 246(5) of Code of<\/p>\n<p>Criminal Procedure, the documents cannot be produced.<\/p>\n<p>Section 311 of Code of Criminal Procedure enables the<\/p>\n<p>Magistrate at any stage of the trial to summon any person<\/p>\n<p>and examine as a witness or to recall and reexamine<\/p>\n<p>Crl.M.C.No.4716\/2008<br \/>\n<span class=\"hidden_text\">                              -4-<\/span><\/p>\n<p>a witness already examined, if it appears to him that it is<\/p>\n<p>necessary for a just decision in the case. The Magistrate<\/p>\n<p>should not have dismissed the petition without considering<\/p>\n<p>the crucial aspect, viz. whether it is necessary for a just<\/p>\n<p>decision of the case. As this aspect was omitted to be taken<\/p>\n<p>note of by the Magistrate, Annexure V order is quashed.<\/p>\n<p>The Magistrate is directed to reconsider and pass<\/p>\n<p>appropriate order in CMP No.3139\/2008 in accordance with<\/p>\n<p>law in the light of the above observations after hearing the<\/p>\n<p>prosecution and the defence.\n<\/p>\n<p>      5.    CMP No.3140\/2008 was rightly dismissed by the<\/p>\n<p>Magistrate holding that the accused cannot be directed to<\/p>\n<p>produce documents as sought for. The prayer is to direct<\/p>\n<p>the accused to produce the documents under Section 91 of<\/p>\n<p>Code of Criminal Procedure, which is not maintainable.
