 lnspectogof Lokayutha, K.C.Lakshrninaryana. _<\/p>\n
‘ :V”*l.odge’di a..:\u00a2s”uo~moto complaint on 22.9.2010 to the effect<\/p>\n
“..t1iatVin7’sjrespect of acquisition of lands for the purpose<\/p>\n
of..es_tah1ishment of Hardware Park, 131’. Park, Aero<\/p>\n
  vli\ufb01ipace, Metro and High Speed ‘1’ rain and other projects,<\/p>\n
it came to light that several irregularities have been
\ncommitted by the Special Land Acquisition Officer of<\/p>\n
the KIADB who was in charge during the relevant<\/p>\n

 after one Rukmangada came and<\/p>\n
“info;fIIield’ about certain corrupt practices that had<\/p>\n
 ..  place in respect of the land of one Srnt.Kamala<\/p>\n
dbeing acquired, the Lokayuktha Inspector. after<\/p>\n
examining the whole matter, noticed several
\nirregularities committed in the distribution of<\/p>\n
compensation to Various persons and those<\/p>\n
e<\/p>\n

irregularities numbering 10 having been highlighted in
\nthe complaint itself and some of them are that, the<\/p>\n
compensation had been given in respect of rno’re”flan.ds<\/p>\n
than what was acquired; though the cases  <\/p>\n

have been distributed; in  of <\/p>\n
claimants were found to begplnot genuinefclalivrns and in<\/p>\n
some cases, it was aiso noticejd that in respect of one

 after Ve1″iTying the records, the complaint was<\/p>\n
   13 accused persons for the offences as<\/p>\n
A  As far as this petitioner is concerned, it<\/p>\n
 A is Qalleged that he was the Spl.Land Acquisition officer<\/p>\n
A *  the period from 21.11.2005 to 26.03.2009 and<\/p>\n
i it was during his tenure, the illegalities that are noted<\/p>\n
in the complaint at page No. 11 of this petition said to<\/p>\n
have taken place. – Therefore, the complaint of the<\/p>\n

the Spl.LAO during the aforementioned period from\n<\/p>\n

\nland acquisition proceedings that took place even far<\/p>\n
too earlier and the amount of compensation said to<\/p>\n

Senior” Counsel his  the petitioner is suffering from<\/p>\n

 consideration. Learned Senior Counsel also relied on<\/p>\n
the ‘decision reported in 1980 (1) Supreme Court Cases<\/p>\n
  to contend that pre–trial detention for a<\/p>\n
considerable period of time goes against the spirit of
\nthe Code and the Constitution. Mainly because the
\ninvestigating agency has got to record the statements<\/p>\n
of some of the witnesses, that itself cannot be made a<\/p>\n

ground to refuse bail, so long as the prosecution<\/p>\n
apprehension with regard to tampering of evidenc’e”‘a\ufb01d:<\/p>\n

As such, the learned Senior Co1:1nse1\u00ab  that
\nthe petitioner be released  <\/p>\n
conditions.\n<\/p>\n
6. Smt.T.M.Gaya’thii,A ‘t–1ea.rrie(i.hj..Sip1.,P.P. for the
\nLokayuktha on her part\u00bb.  objections<\/p>\n
\ufb02ied, argued\u00bb  _;_the_: cp~e::tsp\u00a7nfer teas the Sp1.LAO<\/p>\n
during the Vtpez\u00e9roidi \u00a3005 to 2009 and it<\/p>\n
 Qefiod, several iilegalities and
\nirregaiaritiesxii  to the distribution of
\n has: taken place and having regard to
\n‘  of complaint and the illegaiities noticed<\/p>\n
” .  investigation, grant of Sail. to this petitisner<\/p>\n
is not warranted. It is her submission that when the<\/p>\n
 _ V raid was conducted, huge arncmnt was recovered fronr ‘ I<\/p>\n
 the house of this petitioner. Under these.”<\/p>\n
circumstances, having regard to the magnitude of the<\/p>\n
offences alleged against this petitiener and several<\/p>\n
if<\/p>\n
other accused persons. grant of bail is therefore not<\/p>\n
warranted.\n<\/p>\n
7. Having thus heard both sides, <\/p>\n
consideration is, whether the petitioner can -be rel_egas.:–j:dll ‘<\/p>\n
on bail or not’?\n<\/p>\n
8. The complaint   as this
\npetitioner is concerriedare heltwttas working

Sections ‘and____8 are being made out against the<\/p>\n

far Section 8 of the RC. Act is concerned, it has to be<\/p>\n
  that this petitioner accepted or obtained or<\/p>\n
attempted to accept from any person, for himself or for
\nany other person, any grati\ufb01cation whatever as a
\nmotive or reward for inducing, by corrupt or illegal<\/p>\n
means, any public servant whether named or<\/p>\n

‘  “doc-u_n1en_ts so far recovered by the investigating agency<\/p>\n
” . and lasxfftheillegalities referred to in the complaint also<\/p>\n
can veri\ufb01ed with reference to the documents which<\/p>\n
  “re in possession of the investigating agency, in my<\/p>\n
view, it is unlikely that the petitioner who is a retired
\nGovernment servant is likely to tamper with the official
\ndocuments at his stage of life. More so, considering the<\/p>\n
health condition of the petitioner as it is stated in the<\/p>\n
\ufb01x<\/p>\n
