L. Pandya, learned APP waives service of Rule on behalf<br \/>\nof respondent.\n<\/p>\n<p>2.\tThis<br \/>\napplication has been preferred under Section-439 of the Code of<br \/>\nCriminal Procedure, in connection with the offence being CR<br \/>\nNo. I-138 of 2011 registered with Navsari Rural Police Station<br \/>\nfor the offences u\/s. 143, 147, 149, 326, 506(2), 323 of the Indian<br \/>\nPenal Code and Section-135 of the Bombay Police Act.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate for the applicants has contended that injured person is<br \/>\nalready discharged from the hospital.  Present applicants are wrongly<br \/>\nbooked in the offence alleged against them.  Prima facie, no role is<br \/>\nestablished against the applicants as alleged against them.<br \/>\nTherefore, present applicants are required to be released on bail.\n<\/p>\n<p>4.\tLearned<br \/>\nAPP has vehemently opposed this application<\/p>\n<p>5.\tHaving<br \/>\nheard the learned Counsel for both the sides and looking to the facts<br \/>\nand circumstances of the case, statement of the witnesses and the<br \/>\nfact that injured person is already discharged from the hospital and<br \/>\nthere is no definite allegation made against the applicants, I am<br \/>\ninclined to grant bail to the applicants.\n<\/p>\n<p>6.\tConsidering<br \/>\nthe above, this application is allowed. The applicants are ordered to<br \/>\nbe released on bail in connection with CR<br \/>\nNo. I-138 of 2011 registered with Navsari Rural Police Station<br \/>\nfor the offence alleged against them in this application on their<br \/>\nexecuting a Bond of Rs.10,000\/- (Rupees ten thousand only) each with<br \/>\none solvent surety of the like amount to the satisfaction of the<br \/>\ntrial Court and subject to the conditions that they shall &#8211;\n<\/p>\n<p>a)\tnot<br \/>\ntake undue advantage of their liberty or abuse their liberty;\n<\/p>\n<p>b)\tnot<br \/>\nto try to tamper or pressurise the prosecution witnesses or<br \/>\ncomplainant in any manner;\n<\/p>\n<p>c)\tmaintain<br \/>\nlaw and order and should cooperate the Investigating Officers;\n<\/p>\n<p>d)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>e)\tnot<br \/>\nleave the country without the prior permission of the concerned<br \/>\nSessions Judge.\n<\/p>\n<p>f)\tfurnish<br \/>\nthe address of their residence to the I.O. and also to the Court at<br \/>\nthe time of execution of the bond and shall not change the residence<br \/>\nwithout prior permission of this Court;\n<\/p>\n<p>g)\tsurrender<br \/>\ntheir passport, if any, to the lower Court within a week.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the concerned<br \/>\nSessions Judge will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the trial Court concerned to give time to furnish the<br \/>\nsolvency certificate if prayed for.\n<\/p>\n<p>9.\tRule<br \/>\nis made absolute.
