No.994\/10\n\n     Sharad Athiya                                       Manish Shrivastava\n\n\n\n\n     18.4.2011\n           Shri Vipin Yadav, Counsel for petitioner.\n             Shri S.S.Bisen, Counsel for respondent.<\/pre>\n<p>             This application is filed alleging non-compliance of the order<br \/>\n     dated 30.6.2010 in W.P.No.7831\/10 by which following directions<br \/>\n     were issued:-\n<\/p>\n<blockquote><p>             &#8220;(i)    Petitioner to submit fresh representation to the<br \/>\n             Collector, Sagar agitating his grievance as raised in<br \/>\n             Annexure P-9 Along with the representation he shall<br \/>\n             enclose a copy of this petition for ready reference of<br \/>\n             respondent No.3.\n<\/p><\/blockquote>\n<blockquote><p>             (ii)    Respondent No.3 on receipt of the aforesaid, shall<br \/>\n             decide the representation of the petitioner expeditiously as<br \/>\n             far as possible within a period of 30 days from the date of<br \/>\n             filing of the same.\n<\/p><\/blockquote>\n<blockquote><p>             (iii)   It is made clear that no opinion on the merit of the<br \/>\n             case has been expressed by this Court and the<br \/>\n             respondent No.3 is free to decide the representation in<br \/>\n             accordance with law.&#8221;<\/p><\/blockquote>\n<p>             A reply has been filed in which respondent has stated that by<br \/>\n     order dated 28.2.2011, representation of the petitioner has been<br \/>\n     decided. Though it is submitted by the petitioner that the aforesaid<br \/>\n     order has been passed without application of mind and incorrect<br \/>\n     reasons have been assigned in rejecting the representation, but by<br \/>\n     order    30.6.2010,    respondent    was   directed    to   decide     the<br \/>\n     representation. If petitioner feels aggrieved by the aforesaid decision,<br \/>\n     petitioner may assail the order dated 28.2.2011 by filing a fresh<br \/>\n     petition, but no case is made out for proceeding further.
