     By this petition for writ, a direction is sought<\/p>\n
by the petitioner for his promotion to the post of<\/p>\n
Mistry    Grade-I   from    the    date    person        junior    to   him<\/p>\n
stood promoted as such.\n<\/p>\n<\/p>\n
     In    brief,   the    facts of       the    case are     that      the<\/p>\n
petitioner    was    employed      with     Indira        Gandhi    Canal<\/p>\n
Project (hereinafter referred to as I.G.N.P.) as mason<\/p>\n
on work-charge basis with effect from 13th July, 1975.<\/p>\n
One Shri Ishwar Lal was also employed as mason in

work-charge cadre with I.G.N.P. On 22nd                               April, 1980.<\/p>\n
The petitioner as well as Shri Ishwar Lal both were<\/p>\n
employed        in     16th    Division           of     I.G.N.P.,           Bikaner.<\/p>\n
Respondents          under    an     order     dated         01st    October,      1983<\/p>\n
allowed promotion to Ishwar Lal to the post of Mistry<\/p>\n
Grade-I as per provisions of the Standing Order for<\/p>\n
workmen     engaged           on     work-charge              establishment          in<\/p>\n
Rajasthan Canal Project. Being aggrieved by the same,<\/p>\n
petitioner       submitted           a    complaint          to      the    competent<\/p>\n
authority of the department and by acting upon the<\/p>\n
same, by order dated 10th August, 1992, promotion given<\/p>\n
to Shri Ishwar Lal vide order dated 01st October, 1983<\/p>\n
was withdrawn.\n<\/p>\n
      Shri Ishwar Lal assailed validity of the order<\/p>\n
dated 10th August, 1992 by preferring a petition for<\/p>\n
writ before this Court and that came to be accepted on<\/p>\n
the   count      that        the     order       impugned           was    passed    in<\/p>\n
violation        of          principles           of         natural         justice,<\/p>\n
accordingly,          an     order       dated    07th       August,       1996     was<\/p>\n
passed     by        the     Executive        Engineer,             16th   Division,<\/p>\n
I.G.N.P.,       Bikaner,       withdrawing             the     order       dated    10th<\/p>\n
August, 1992. Accordingly, position of Ishwar Lal as<\/p>\n
Mistry Grade-I as that was prior to 10th August, 1992<\/p>\n
stood restored.\n<\/p>\n<\/p>\n
      The petitioner again approached to respondents by<\/p>\n
way   of   submitting          representation,               with     a    claim    for<\/p>\n
promotion       as    Mistry       Grade-I       being        senior       to   Ishwar

Lal. On being failed to get any favourable decision<\/p>\n
from the respondents, he approached this Court by way<\/p>\n
of filing this petition for writ.\n<\/p>\n<\/p>\n
      It is stated by learned counsel for petitioner<\/p>\n
that the petitioner as well as Ishwar Lal both were<\/p>\n
working in 16th Division, I.G.N.P., Bikaner and in the<\/p>\n
aforesaid Division, petitioner being senior to Ishwar<\/p>\n
Lal should have been promoted first as Mistry Grade-I.<\/p>\n
Per   contra,       it    is     stated        by    the   respondents           that<\/p>\n
seniority    in      I.G.N.P.        is    require         to    be    maintained<\/p>\n
unit-wise      in        accordance        with       applicable           Standing<\/p>\n
Orders   and      the      petitioner          was     working        in   a     unit<\/p>\n
different to unit in which Ishwar Lal was working,<\/p>\n
therefore,      seniority         of      both       persons      can      not     be<\/p>\n
equated. It is asserted that promotion was given to<\/p>\n
Ishwar Lal in the unit in which he was working.<\/p>\n
      Heard learned counsel for the parties.<\/p>\n
      Under the Standing Order for workmen engaged on<\/p>\n
work-charge cadre in Rajasthan Canal Project, the term<\/p>\n
‘unit’ means – “territorial jurisdiction of authority<\/p>\n
competent       to        make       appointment            on        work-charge<\/p>\n
establishment”.           In   the     same         Standing     Order,        Chief<\/p>\n
Engineer,    I.G.N.P.          under      an    office      order      dated     25th<\/p>\n
June, 1981 framed “The Rajasthan Canal Project Work-<\/p>\n
charge Employees Promotion Rules, 1981”. As per those

Rules, Appointing Authority to work-charge cadre are<\/p>\n
Chief          Engineer\/Additional                    Chief         Engineer,<\/p>\n
Superintending         Engineers          and     Executive        Engineers.<\/p>\n
Assistant Engineer, under the Rules of 1981, is having<\/p>\n
no   authority       to     make    appointment        and    as    such,    the<\/p>\n
units as defined under the Standing Order could be at<\/p>\n
the minimum level of Executive Engineer.<\/p>\n
       It is not in dispute that the petitioner as well<\/p>\n
as Shri Ishwar Lal both were working in 16th Division<\/p>\n
of   I.G.N.P.,        Bikaner       and    that     Division       is    within<\/p>\n
territorial jurisdiction and control of the Executive<\/p>\n
Engineer. The unit of the petitioner as well as of<\/p>\n
Shri Ishwar Lal, therefore, is 16th Division, I.G.N.P.,<\/p>\n
Bikaner        and     no      other      sub-division.            Petitioner,<\/p>\n
therefore,      rightly        claimed      seniority        vis-a-vis      Shri<\/p>\n
Ishwar Lal.\n<\/p>\n<\/p>\n
       From     perusal        of      document       Annx.1,       that     is,<\/p>\n
seniority list relating to work-charge Masons working<\/p>\n
in I.G.N.P., name of petitioner is shown at serial<\/p>\n
No.2 whereas name of Ishwar Lal is at serial No.5.<\/p>\n
This    fact    also      establishes       that      the    petitioner      and<\/p>\n
Shri Ishwar Lal were working in the same unit and<\/p>\n
petitioner is senior to Shri Ishwar Lal. Respondents<\/p>\n
have    already       given     promotion        to    Shri       Ishwar    Lal,<\/p>\n
ignoring claim of the petitioner, who is senior to<\/p>\n
him.    There    is       no   just    reason      for      not    considering

 candidature of the petitioner for promotion as Mistry<\/p>\n
 Grade-I from the date the same is accorded to Shri<\/p>\n
 Ishwar Lal.\n<\/p>\n<\/p>\n
      Accordingly,   this   petition       for     writ     deserves<\/p>\n
 acceptance and the same is allowed. Respondents are<\/p>\n
 directed to consider candidature of the petitioner for<\/p>\n
 the purpose of promotion to the post of Mistry Grade-I<\/p>\n
 from the date same was accorded to Shri Ishwar Lal. If<\/p>\n
 the petitioner is otherwise found suitable, promotion<\/p>\n
 as aforesaid be given to him.\n<\/p>\n<\/p>\n
      No order as to costs.\n<\/p>\n<\/p>\n
