     The challenge in this Rent Control      Revision filed by the<\/p>\n
defeated tenant petitioner under Section 20 of the Kerala<\/p>\n
Buildings (Lease and Rent Control) Act is to the judgment of the<\/p>\n
Appellate   Authority  & District Judge, Kozhikode in RCA<\/p>\n
No.46\/2003 dated 8\/4\/2005 confirming the order of eviction<\/p>\n
passed by the Rent Controller\/Munsiff of Vadakara in          RCP<\/p>\n
No.12\/2002 dated 25\/2\/2003         under Section 11(2)(b) and 11<\/p>\n
(3) of the Act.\n<\/p>\n
     2. The revision respondent\/landlady filed RCP No.12\/2002<\/p>\n
before the Rent Controller (Munsiff), Vadakara claiming eviction<\/p>\n
under Section 11 (2)(b) and 11(3) of the Act alleging that the<\/p>\n
tenant has kept the rent in arrears from February 1997 onwards<\/p>\n
and that the revision respondent\/landlady requires the petition<\/p>\n
schedule shop room for her daughter to conduct a tailoring<\/p>\n
business, that there are no other suitable building available in<\/p>\n
the locality for the landlady to conduct business and that the<\/p>\n
tenant is not depending for his livelihood on the income derived<\/p>\n

from the business conducted in the petition schedule shop room.<\/p>\n
      3. The tenant resisted the claim contending that there is no<\/p>\n
rent in arrears, that bonafide need put forward by the landlady is<\/p>\n
not genuine, that the landlady has other suitable building in that<\/p>\n
locality to conduct tailoring shop and that the tenant is entitled to<\/p>\n
the protection of the 1st and 2nd provisos to sub section (3) of<\/p>\n
Section 11 of the Act.\n<\/p>\n
      4. Before the Rent Control Court, the landlady’s husband<\/p>\n
was examined as PW1 and her daughter as PW2 and she<\/p>\n
produced Exts.A1 to A16. The tenant was examined as RW1 and<\/p>\n
he produced Exts.B1 and B2. On an appreciation of the evidence,<\/p>\n
the Rent Control Court found that the rent is in arrears and that<\/p>\n
the bonafide need put forward by the landlady is genuine, that<\/p>\n
the tenant is not depending for his livelihood on the income<\/p>\n
derived from the petition schedule shop room and ordered<\/p>\n
eviction under Section 11(2)(b) and 11(3) of the Act.            The<\/p>\n
Appellate Authority on an appeal by the tenant confirmed the<\/p>\n
said findings of the Rent Control Court.      The tenant has now<\/p>\n
come up in revision.\n<\/p>\n
      5. Arguing the revision, Sri. C.Vathsalan, learned counsel<\/p>\n
RCR.No.551\/2005                   3<\/span><\/p>\n
for the revision petitioner submitted that the revision petitioner is<\/p>\n
a co-owner of the petition schedule shop room after the death of<\/p>\n
his father from whom he took the shop room on rent and that<\/p>\n
therefore the revision respondent is not entitled to an order of<\/p>\n
eviction.  This aspect is disputed by      Sri.B.Krishnan, learned<\/p>\n
counsel for the revision respondent.\n<\/p>\n
      6. As regards the contention raised by the revision<\/p>\n
petitioner that he is a co-owner of the petition schedule shop<\/p>\n
room, no such contention was raised either in the pleadings or in<\/p>\n
evidence before the Rent Control Court or before the Appellate<\/p>\n
Authority by the tenant.     On the other hand, in the counter<\/p>\n
statement filed by the tenant before the Rent Control Court, it is<\/p>\n
admitted that the revision respondent is the owner of the said<\/p>\n
building and that he has paid the rent upto 1997 to the revision<\/p>\n
respondent. Therefore, we find no merit in the above contention<\/p>\n
raised by the revision petitioner.\n<\/p>\n
      7. We have gone through the evidence adduced by the<\/p>\n
landlady and the tenant before the Rent Control Court and the<\/p>\n
order of the Rent Control Court and the judgment of the<\/p>\n
Appellate Authority.     We find no ground to interfere with the<\/p>\n

concurrent findings entered by the Rent Control Court and the<\/p>\n
Appellate Authority.       We find no irregularity, illegality or<\/p>\n
impropriety in the order of the Rent Control Court as well as in<\/p>\n
the Judgment of the Appellate Authority to invoke our revisional<\/p>\n
jurisdiction under Section 20 of the Act.      That being so, the<\/p>\n
revision petition has to be dismissed.\n<\/p>\n
      8. Lastly, Sri.C.Vathsalan, learned counsel for the revision<\/p>\n
petitioner submitted that at least one year time may be granted<\/p>\n
to the revision petitioner to vacate the premises. This is opposed<\/p>\n
by Sri.Krishnan, learned counsel for the revision respondent.<\/p>\n
Taking into consideration the fact that the revision petitioner is<\/p>\n
conducting a tea shop in the petition schedule building, we feel<\/p>\n
that time till 28\/2\/2010 can be granted to the revision petitioner<\/p>\n
on the following conditions:\n<\/p>\n
                  i). The revision petitioner shall file<\/p>\n
            an affidavit before the      Rent Control<\/p>\n
            Court within one month from this date<\/p>\n
            agreeing    to    surrender       peaceful<\/p>\n
            possession of the petition schedule shop<\/p>\n
            room to the revision respondent on or<\/p>\n

           before 28\/2\/2010.       On receipt of such<\/p>\n
           affidavit, the Executing Court shall defer<\/p>\n
           the delivery to 1\/3\/2010.<\/p><\/blockquote>\n
<\/blockquote>\n
                 ii). The revision petitioner shall pay<\/p>\n
           arrears of rent up to date within one<\/p>\n
           month from this date and future rent as<\/p>\n
           and when the same falls due,           failing<\/p>\n
           which the revision petitioner will not be<\/p>\n
           entitled to the benefit of time granted by<\/p>\n
           this order.<\/p><\/blockquote>\n
      8. We hereby make it clear that the order passed in this<\/p>\n
revision will not affect the right of the revision petitioner to claim<\/p>\n
his alleged right as a co-owner in appropriate proceedings before<\/p>\n
the appropriate forum.\n<\/p>\n
      In the result, the revision petition is dismissed with the<\/p>\n
above directions.\n<\/p>\n
