Justice ANTONY DOMINIC\n\n Dated :25\/10\/2007\n\n O R D E R\n                          ANTONY DOMINIC, J.\n\n                         ===============\n\n                    W.P.(C) NO. 31652 OF 2007 R\n\n                  =====================\n\n\n             Dated this the 26th day of October, 2007\n\n\n                               J U D G M E N T\n<\/pre>\n<p>      Petitioner seeks a declaration that the 1st  respondent is not<\/p>\n<p>entitled  to  insist  that  the  petitioner  shall  produce any  clearance<\/p>\n<p>certificate   or   proof   regarding   remittance   of   contribution   of   the<\/p>\n<p>dues   to   the   3rd  respondent.   Since   the   establishment   of   the<\/p>\n<p>petitioner   is   covered   under   the   provisions   of   the   Employees<\/p>\n<p>Provident Fund and Miscellaneous Provisions Act, 1952, this court<\/p>\n<p>has   already   accepted   such   a   contention   in   several   cases   and<\/p>\n<p>Ext.P4 is one of the judgments, where it has been held that the<\/p>\n<p>petitioner therein is entitled to exemption by virtue of the proviso<\/p>\n<p>to   Section   4(1)   of   the   Kerala   Motor   Transport   Workers   Welfare<\/p>\n<p>Fund   Act.     In   this   case,   as   is   evident   from   Exts.   P1   to   P3,<\/p>\n<p>establishment of the petitioner is covered by the provisions of the<\/p>\n<p>Employees   Provident   Fund   and   Miscellaneous   Provisions   Act,<\/p>\n<p>1952, and that contributions have been paid up to date.<\/p>\n<p>      In   view   of   the   position   as   above,   I   dispose   of   this   writ<\/p>\n<p>WPC  31652\/07<\/p>\n<p><span class=\"hidden_text\">                                      : 2 :<\/span><\/p>\n<p>petition   directing   the   1st  respondent   to   permit   the   petitioner   to<\/p>\n<p>remit   Motor   Vehicles   Tax   in   respect   of   the   vehicles   owned   and<\/p>\n<p>possessed by him, on production of proof that the petitioner has<\/p>\n<p>paid its dues to the 2nd respondent.\n<\/p>\n<\/p>\n<p>                                               ANTONY DOMINIC, JUDGE.\n<\/p>\n<p>Rp<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court S.Mohammed Basha vs The Regional Transport Officer on 25 October, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C) No. 31652 of 2007(R) 1.
