No.642 OF 2009\n                     -------------------------------\n            Dated this the 25th day of March, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p>                         ~~~~~~~~~~~<\/p>\n<p>Balakrishnan Nair, J.\n<\/p>\n<p>     The writ petitioner is the appellant. He approached this<\/p>\n<p>Court challenging Ext.P4 order, as per which, he has been<\/p>\n<p>transferred from Kottayam to Guwahati.             He is an Assistant<\/p>\n<p>Security Officer working under the respondents. According to<\/p>\n<p>him, the transfer is vitiated by malafidies. Since he is a member<\/p>\n<p>of a Scheduled Caste, he is being harassed and discriminated.<\/p>\n<p>The respondents on the other hand submitted that one post of<\/p>\n<p>Assistant Security Officer has been shifted from Kerala to<\/p>\n<p>Guwahati.     The petitioner being the senior-most, among the<\/p>\n<p>Security Officers serving in Kerala, has been transferred to<\/p>\n<p>Guwahati. The said transfer is made in exigencies of service.<\/p>\n<p>They denied the allegations of malafidies imputed against them<\/p>\n<p>by the appellant. A transfer can be impugned under Article 226<\/p>\n<p>of the Constitution of India only on two grounds. They are<\/p>\n<p>     1) the transfer is contrary to any statutory provision.<\/p>\n<p>     2) It is vitiated by malafidies.\n<\/p>\n<p><span class=\"hidden_text\">W.A.No.642\/2009                   2<\/span><\/p>\n<p>     2.    The learned Single Judge, who heard the writ petition,<\/p>\n<p>dismissed it holding that the transfer has been ordered in<\/p>\n<p>exigencies of service. Hence, this appeal.<\/p>\n<p>     3.    The learned counsel for the appellant vehemently<\/p>\n<p>contended before us that the appellant has been transferred to<\/p>\n<p>harass him. His transfer is vitiated by malafidies. The said<\/p>\n<p>contention of the appellant is disputed by the respondents.<\/p>\n<p>Allegations of malafidies are easily made. But, it is difficult to<\/p>\n<p>substantiate them. We do not find any material to arrive at a<\/p>\n<p>conclusion that the transfer is vitiated by malafidies.
