Further relief is prayed to direct respondent No.2 to<br \/>\npay an amount of gratuity as per order passed by Controlling<br \/>\nAuthority.\n<\/p>\n<p>3.\tThe<br \/>\nControlling Authority has passed an order which is at Annexure-A<br \/>\n(Page-18) in Gratuity Application No.4\/2009 in favour of present<br \/>\npetitioner wherein Controlling Authority has directed to Limdi<br \/>\nMunicipality to pay amount of gratuity of Rs.1,81,188.90 with 10%<br \/>\nsimple interest w.e.f. 1.11.2007 by order dated 28.4.2009, which<br \/>\norder has been communicated to Chief Officer, Limdi Municipality by<br \/>\nControlling Authority on 28.4.2009.\n<\/p>\n<p>4.\tThe<br \/>\npetitioner has retired on 30.9.2007, is also entitled the amount of<br \/>\nencashment leave of Rs.1,16,319\/- as per office order dated 21.9.2010<br \/>\npassed by Chief Officer, Limdi Municipality. Similarly, on 30.7.2010,<br \/>\namount of gratuity is also directed to be paid to petitioner by Chief<br \/>\nOfficer, Limdi Municipality which comes to Rs.1,61,189\/- after<br \/>\ndeducting advance payment of Rs.20,000\/-. Thereafter, request was<br \/>\nmade by petitioner to Chief Officer, Limdi Municipality and on<br \/>\n30.9.2009 (page-20), a recovery certificate has been issued by<br \/>\nControlling Authority under Section 8 in favour of District<br \/>\nCollector, Surendranagar. But no steps have been taken so far and<br \/>\ntherefore, present petition is filed.\n<\/p>\n<p>5.\tIn<br \/>\nlight of this background, it is directed to District Collector,<br \/>\nSurendranagar to execute the recovery certificate dated 30.9.2009<br \/>\n(Page-25) to recover the amount from Chief Officer, Limdi<br \/>\nMunicipality as early as possible, within a period of one month from<br \/>\ndate of receiving copy of present order while exercising powers under<br \/>\nprovisions of Bombay Land Revenue Code and after recovering the<br \/>\namount, deposit the said amount with Controlling Authority at Limdi<br \/>\nand to communicate these facts to petitioner immediately.\n<\/p>\n<p>6.\tIn<br \/>\nview of above observations and directions, present petition is<br \/>\ndisposed of without expressing any opinion on merits.
