The RTI application<br \/>\nwas forwarded to them for further action.\n<\/p>\n<p>First Appeal:\n<\/p>\n<p>Unsatisfactory information provided by the PIO.\n<\/p>\n<p>Order of the FAA:\n<\/p>\n<p>Not ordered.\n<\/p>\n<p> Ground of the Second Appeal:\n<\/p>\n<p>Incomplete information provided by the PIO and inaction on the part of the FAA.\n<\/p>\n<p>Relevant Facts emerging during Hearing:\n<\/p>\n<p>The following were present<br \/>\nAppellant : Ms. Sarita Chaudhary;\n<\/p>\n<p>Respondent : Mr. Naresh Kumar Sharma, SO on behalf of Mrs. Uma Bali, Public Information Officer &amp;<br \/>\n               Under Secretary (UGC);\n<\/p>\n<p>The Respondent informs the Commission all the information pertains to AICTE and hence the RTI<br \/>\napplication has been transferred to the PIO AICTE on 09\/11\/2009. It appears that PIO AICTE has not sent<br \/>\nany information to the Appellant.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>      PIO AICTE is directed to give the information to the Appellant before<br \/>\n10 February 2011.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information by the PIO<br \/>\nAICTE within 30 days as required by the law.<br \/>\nFrom the facts before the Commission it appears that the PIO AICTE is guilty of not furnishing<br \/>\ninformation within the time specified under sub-section (1) of Section 7 by not replying within 30 days, as<br \/>\nper the requirement of the RTI Act.\n<\/p>\n<p>It appears that the PIO&#8217;s actions attract the penal provisions of Section 20 (1). A showcause notice is<br \/>\nbeing issued to him, and he is directed give his reasons to the Commission to show cause why penalty<br \/>\nshould not be levied on him.\n<\/p>\n<p>PIO AICTE will give his written submissions showing cause why penalty should not be imposed on him<br \/>\nas mandated under Section 20 (1) before 10 February, 2011.
