Nanavay, learned Senior Counsel appearing for the applicants<br \/>\nsubmits that, in the first information report, property Nos. 76\/3,<br \/>\n77\/3, 78\/3 and 79 of 3 and other lands along with factory building,<br \/>\nmachinery, etc. situated at village Paliyad, is alleged to have been<br \/>\npurchased and transferred by the applicants fraudulently, however,<br \/>\nso far as applicant No.1 is concerned, he is not named in the first<br \/>\ninformation report and, so far as applicant No.2 is concerned,<br \/>\ntransaction was entered into by the father of applicant No.2. Without<br \/>\nadmitting and without prejudice to the rights and contentions, it  is<br \/>\nsubmitted that, for the transactions carried out by the elders of the<br \/>\nfamily, the applicants cannot be held liable. It is further submitted<br \/>\nthat, in 2008 and 2009, two civil suits were filed in respect of the<br \/>\nalleged sale deeds and, in one of the suits, the Civil Court has<br \/>\nrestrained the purchasers from transferring the property to any third<br \/>\nparty.  It is further submitted that the complaint is filed after<br \/>\nperiod of one and half years after filing of the suits. Considering<br \/>\nthe nature of allegations and the fact that the applicants will be<br \/>\navailable during the course of trial being stationed at Paliyad,<br \/>\nDistrict Surendranagar, they may be enlarged on bail.\n<\/p>\n<p>2\tMr.\n<\/p>\n<p>S.V. Raju, learned Senior Counsel appearing for the complainant has<br \/>\nopposed to grant of bail and submitted that nature of transaction<br \/>\nincluding execution of banakhat and subsequent cancellation and<br \/>\nexecution of sale deeds on the same day would reveal that the<br \/>\napplicants herein intended to transfer the property though they were<br \/>\nnot owners and, therefore, the offences are registered for which this<br \/>\nCourt considering seriousness and gravity of offences would not like<br \/>\nto enlarge the applicants on bail. Besides, it  is submitted that<br \/>\ninitiation of proceedings of civil nature may not have any bearing on<br \/>\ncriminal case and, if the facts disclose criminality of the offences,<br \/>\nregistration of first information report by itself cannot be said to<br \/>\nbe in any manner a procedure or process undertaken by the complainant<br \/>\nfor oblique motive.\n<\/p>\n<p>3\tLearned<br \/>\nAPP has also opposed to grant of bail looking to gravity of offences.\n<\/p>\n<p>4\tHaving<br \/>\nheard the learned counsel for the parties and on perusal of the<br \/>\nrecord, considering the nature of transaction, belated action on the<br \/>\npart of the complainant, pendency of civil proceedings to which not a<br \/>\nwhisper is made in the first information report, the<br \/>\nrole  attributed to the applicants,   without discussing the evidence<br \/>\nin detail, prima facie, this Court is of the opinion that this is a<br \/>\nfit case to exercise the discretion to enlarge the applicants on<br \/>\nbail.\n<\/p>\n<p>5\tThe<br \/>\nparties do not press for further reasoned order.\n<\/p>\n<p>6\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicants are ordered to be released on bail in connection<br \/>\nwith  first information report registered at I-35 of 2010 with<br \/>\nPaliyad Police Station, for the offences punishable under Sections<br \/>\n380, 403, 427, 441, 451, 467, 468, 471, 114 and 120B of the Indian<br \/>\nPenal Code, on their executing a bond of Rs.5,000\/- (Rupees five<br \/>\nthousand only) each with one surety of the like amount to the<br \/>\nsatisfaction of the trial court and subject to the conditions that<br \/>\nthey shall<\/p>\n<p> i.\tnot<br \/>\ntake undue advantage of their liberty or misuse their liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injuries to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\ttheir passports, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\ttheir presence at the concerned police station on the first Sunday<br \/>\n\tof every month between 10 a.m. And 3 p.m till commencement of trial.\n<\/p>\n<p>furnish<br \/>\n\tthe present  address of their residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>\tThe<br \/>\nAuthorities will release the applicants only if they are not required<br \/>\nin connection with any other offence for the time being. If breach of<br \/>\nany of the above conditions is committed, the Sessions Judge<br \/>\nconcerned will be free to issue warrant or take appropriate action in<br \/>\nthe matter. Bail bond to be executed before the lower court having<br \/>\njurisdiction to try the case. At the trial, the trial court shall not<br \/>\nbe influenced by the observations of preliminary nature, qua the<br \/>\nevidence at this stage, made by this Court while enlarging the<br \/>\napplicants on bail.\n<\/p>\n<p>\tRule<br \/>\nis made absolute to the aforesaid extent.
