Justice M.L.JOSEPH FRANCIS\n\n Dated :25\/05\/2010\n\n O R D E R\n           K.M.JOSEPH &amp; M.L.JOSEPH FRANCIS, JJ.\n         ------------------------------------------------------\n                 W.P.(C) No.20424 of 2009-W\n            ----------------------------------------------\n             Dated, this the 25th day of May, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p>K.M.Joseph, J.\n<\/p>\n<p>             The prayers in the writ petition are as follows:&#8211;<\/p>\n<p>    &#8220;i.   to declare that the petitioners are entitled to<\/p>\n<p>    practice electropathy\/electro homeopathy and neither<\/p>\n<p>    the respondents nor any other person or persons<\/p>\n<p>    have any manner of right or authority to interfere<\/p>\n<p>    with the petitioner&#8217;s practice of the aforesaid system<\/p>\n<p>    of medicine.\n<\/p>\n<p>    ii.   to issue a writ of mandamus or any other<\/p>\n<p>    appropriate writ direction or order directing the<\/p>\n<p>    respondents not to interfere with electropathy\/electro<\/p>\n<p>    homeopathy practice of the petitioners.<\/p>\n<p>    Iii. To issue a writ of mandamus or any other<\/p>\n<p>    appropriate writ direction or order directing the 2nd<\/p>\n<p>    and 3rd respondents not to harass or to intimidate the<\/p>\n<p>    petitioners or to obstruct them in their practice in<\/p>\n<p>    electropathy\/electro homeopathy.&#8221;\n<\/p>\n<p>             2.   Briefly put, the case of the petitioners is as<\/p>\n<p>follows:&#8211; Petitioners are practitioners of electropathy\/electro<\/p>\n<p>homeopathy.        There is no statute, rules or regulations<\/p>\n<p>restricting the practice of electropathy\/electro homeopathy.<\/p>\n<p>They have fundamental right under Article 19 (1) (g) of the<\/p>\n<p><span class=\"hidden_text\">WPC 20424\/2009                                 -2-<\/span><\/p>\n<p>Constitution.      Petitioners have produced Exts.P1 and P2<\/p>\n<p>certificates. Exts.P5 is the judgment of this Court and Ext.P6<\/p>\n<p>is the judgment of High Court of Delhi which are in their<\/p>\n<p>favour.   Ext.P7 is the     order of the Directorate of Health<\/p>\n<p>Services , Government of NCT, Delhi. Ext.P8 is the judgment<\/p>\n<p>of the Division Bench of this Court.\n<\/p>\n<p>             3. We would think that the issue raised ought to<\/p>\n<p>be answered on the lines of Ext.P8 judgment. We respectfully<\/p>\n<p>follow the same and dispose of the writ petition as follows:<\/p>\n<p>             The State or its agents shall not interfere in the<\/p>\n<p>practice   of     electropathy\/electro    homeopathy     by  the<\/p>\n<p>petitioners. But, the petitioners shall not use designations<\/p>\n<p>like &#8216;Doctor&#8217; etc.   They shall not practice Modern Medicine,<\/p>\n<p>Homeopathy or any of the Indian systems of Medicine. They<\/p>\n<p>shall not act in violation of the provisions of the Kerala Abkari<\/p>\n<p>Act or Drugs and Cosmetics Act or other relevant Acts or<\/p>\n<p>Rules.    If the petitioners continue with the practice of<\/p>\n<p>electropathy\/electro homeopathy without infringing any other<\/p>\n<p>provisions of law, the police shall not interfere with the same.<\/p>\n<p>Unless the petitioners commit some cognizable offence by<\/p>\n<p><span class=\"hidden_text\">WPC 20424\/2009                              -3-<\/span><\/p>\n<p>practicing electropathy\/electro homeopathy, the police have<\/p>\n<p>no power or authority to interfere with their practice or<\/p>\n<p>summon them to the police station with a view to prevent<\/p>\n<p>their practice of electropathy\/electro homeopathy.
