The learned Public<br \/>\n\tProsecutor has placed on record<br \/>\n\tthe affidavit affirmed by Shri G.S.Khaira, Dy. Superintendent,<br \/>\n\tCentral Prison, Ahmedabad, indicating that the State would take a<br \/>\n\tfresh decision independent of the earlier decision taken by the<br \/>\n\tState Government on the basis of the report of the Committee and<br \/>\n\tconsidering all the aspects of the case, the decision would be taken<br \/>\n\ton or before 30.6.2011. In view of this affidavit, Shri Sinha<br \/>\n\tsubmitted that the State be directed to take decision without being<br \/>\n\tinfluenced by the earlier order which is impugned in this petition<br \/>\n\tand the time limit for taking decision which is indicated to be<br \/>\n\t30.6.2011 be curtailed and the decision should be taken as soon as<br \/>\n\tpossible. The Court is of the view that the statement made in para-4<br \/>\n\tof the affidavit is sufficient to take care of anxiety expressed by<br \/>\n\tShri Sinha and, therefore, there is no need to pass any further<br \/>\n\torder thereupon. The time limit prescribed for taking decision is,<br \/>\n\tin fact, based upon the factor<br \/>\n\tlike meeting of Advisory Committee, which has been constituted under<br \/>\n\tthe provisions of the Bombay Jail Manual which is likely to be<br \/>\n\tconvened in the second week or third week of May, 2011. In my view,<br \/>\n\twhen such an affidavit is filed and when State has come forward with<br \/>\n\ta decision to consider the matter for grant of remission to the<br \/>\n\tpetitioner independent of the earlier decision, no further order is<br \/>\n\trequired to be made and hence this petition is disposed of with<br \/>\n\tdirection to State to abide by the affidavit, which is stated to be<br \/>\n\tfiled under the instructions from the State authority concerned.\n<\/p>\n<p>\tThe<br \/>\n\tearlier order thus now have no life and the State is to decide the<br \/>\n\tmatter as is stated in para-4 in the affidavit.
