Kuriakose, J<\/p>\n<p>     The claimants are the appellants in all these<\/p>\n<p>appeals.   L.A.A.591\/09   and    L.A.A.595\/09    pertain<\/p>\n<p>respectively  to   the   judgments    and    decree   in<\/p>\n<p>L.A.R.432\/01 and L.A.R.244\/01. L.A.A.594\/09 and<\/p>\n<p>L.A.A.598\/09 pertain respectively to L.A.R.248\/01 and<\/p>\n<p>L.A.R.234\/00. In the case pertaining to L.A.A.595\/09,<\/p>\n<p>the Land Acquisition Officer awarded land value at the<\/p>\n<p>rate of Rs.682\/- per cent which was re-fixed by the<\/p>\n<p>Reference Court at Rs.2,500\/- per cent on the basis of<\/p>\n<p>the evidence that came on record. In L.A.R.432\/01<\/p>\n<p>corresponding to L.A.A.591\/09, though the Land<\/p>\n<p><span class=\"hidden_text\">L. A. A. Nos.591, 594, 595 &amp; 598 of 2009 -2-<\/span><\/p>\n<p>        Acquisition Officer granted the same rate, the<\/p>\n<p>        Reference Court would re-fix the land value only at the<\/p>\n<p>        rate of Rs.1,500\/- per cent on the basis of the<\/p>\n<p>        evidence which came on record. In the other two<\/p>\n<p>        cases, the Reference Court would re-fix the land value<\/p>\n<p>        at Rs.1,500\/- per cent.\n<\/p>\n<p>               2. Even though several grounds are raised in<\/p>\n<p>        these memorandum of appeals, when they came up<\/p>\n<p>        for hearing Sri.R.Surendran, the learned counsel for<\/p>\n<p>        the appellants would draw our attention to the<\/p>\n<p>        judgment        of    this    Court in  L.A.A.1634\/08  and<\/p>\n<p>        L.A.A.1639\/08.               Those  judgments   pertain to<\/p>\n<p>        acquisition of lands similar to the lands involved in<\/p>\n<p>        these appeals. It is seen from those judgments that<\/p>\n<p>        for the lands for which the Land Acquisition Officer<\/p>\n<p><span class=\"hidden_text\">L. A. A. Nos.591, 594, 595 &amp; 598 of 2009 -3-<\/span><\/p>\n<p>        awarded Rs.682\/- per cent, this Court has re-fixed<\/p>\n<p>        value at Rs.3,000\/- per cent and for the lands for<\/p>\n<p>        which the Land Acquisition Officer awarded value at<\/p>\n<p>        the rate of Rs.486\/- per cent, this Court has re-fixed<\/p>\n<p>        the value at Rs.2,500\/- per cent. The request of the<\/p>\n<p>        learned counsel is that the judgments of this Court<\/p>\n<p>        may be followed and the appeals be allowed.\n<\/p>\n<p>               3. The learned Senior Government Pleaders<\/p>\n<p>        would point out that the appellants have limited their<\/p>\n<p>        claim for enhancement to Rs.500\/- per cent in all the<\/p>\n<p>        appeals. According to the learned Senior Government<\/p>\n<p>        Pleaders, the appellants are not entitled for any<\/p>\n<p>        further enhancement over what they have claimed in<\/p>\n<p>        these appeals.\n<\/p>\n<p>               4. We accept the submission of Sri.R.Surendran<\/p>\n<p><span class=\"hidden_text\">L. A. A. Nos.591, 594, 595 &amp; 598 of 2009 -4-<\/span><\/p>\n<p>        regarding the probative value of the judgments in<\/p>\n<p>        L.A.A.1634\/08 and L.A.A.1639\/08. At the same time,<\/p>\n<p>        we find merit in the submission of the learned Senior<\/p>\n<p>        Government           Pleaders    regarding the appellants&#8217;<\/p>\n<p>        eligibility for enhanced compensation. Under the above<\/p>\n<p>        circumstances, we are inclined to allow all the above<\/p>\n<p>        appeals awarding further enhancement over and<\/p>\n<p>        above what has been awarded by the Reference Court<\/p>\n<p>        at the rate of Rs.500\/- per cent to each of the<\/p>\n<p>        appellants. The appellants will be entitled for all<\/p>\n<p>        statutory benefits on the enhancement which is<\/p>\n<p>        awarded to them under this judgment as admissible<\/p>\n<p>        under Sections 23(2), 23(1A) and Section 28 of the<\/p>\n<p>        Land Acquisition Act.\n<\/p>\n<p>               5. All the above appeals are allowed, but in the<\/p>\n<p><span class=\"hidden_text\">L. A. A. Nos.591, 594, 595 &amp; 598 of 2009 -5-<\/span><\/p>\n<p>        circumstances without any order as to costs.\n<\/p>\n<p>                                             PIUS C.
