MEHTA\n\t\t\n\t\n\n \n\nDate\n: 18\/07\/2008 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>\t\tThe<br \/>\npetitioner-original complainant has preferred this Criminal Revision<br \/>\nApplication under Section 397 read with Section 401 of the Code of<br \/>\nCriminal Procedure, 1973 [?Sthe Code?? for short] and has<br \/>\nchallenged the judgment and order of acquittal dated 24.04.1997<br \/>\nrendered by the learned Additional Sessions Judge, Court No.10,<br \/>\nAhmedabad in Criminal Case No.245 of 1993 acquitting the<br \/>\nrespondents-accused for the offences punishable under Section 302,<br \/>\n452 read with Section 114 of the Indian Penal Code [?SIPC?? for<br \/>\nshort].\n<\/p>\n<p>2.\t\tHead<br \/>\nConstable Dhanjibhai Pitamberbhai of Madhavpura Police Station went<br \/>\nto Civil Hospital on 05.04.1993 on receiving a vardhi<br \/>\nfrom the hospital and found that one Jyotikaben had sustained burns<br \/>\nand, therefore, he made inquiry and wrote a yadi to<br \/>\nExecutive Magistrate for recording her dying declaration. The dying<br \/>\ndeclaration was recorded and the Head Constable went to draw<br \/>\npanchnama of scene of<br \/>\noffence and on the basis of the complaint filed by him with report<br \/>\nsubmitted to the Police Station, an offence was registered as<br \/>\nI-C.R.No.115 of 1993 at Madhavpura Police Station for the offence<br \/>\npunishable under Section 309 of the IPC against Jyotikaben. The<br \/>\nstatement of Jyotikaben was also<br \/>\nrecorded on 05.04.1993. Thereafter, on the basis of complaint filed<br \/>\nby Jyotikaben, offence as I-C.R.No.125 of 1993 under Sections 307,<br \/>\n114 and 452 of the IPC was registered against the respondents-accused<br \/>\nby Madhavpura Police Station. Jyotikaben died during the treatment<br \/>\nand, therefore, postmortem on her dead body was performed. On<br \/>\ncompletion of the investigation, charge-sheet came to be filed<br \/>\nagainst the respondents-accused for the offences punishable under<br \/>\nSections 302, 452 and 114 of the IPC. As the offences were<br \/>\nexclusively triable by a Court of Sessions, the case was committed to<br \/>\nthe Sessions Court for trial. The learned trial Judge framed the<br \/>\ncharge for the aforesaid offences against the respondents-accused and<br \/>\nit was read over and explained to them. The respondents-accused<br \/>\npleaded not guilty to the charge and claimed to be tried. Therefore,<br \/>\nthe prosecution adduced evidence. On completion of recording of<br \/>\nevidence, incriminating circumstances appearing in the evidence<br \/>\nagainst the respondents-accused were explained to them. The<br \/>\nrespondents-accused in their further statements recorded under<br \/>\nSection 313 of the Code denied having committed the offence and<br \/>\nstated that they are innocent.\n<\/p>\n<p>\t\tAfter<br \/>\nhearing the learned Additional Public Prosecutor and the learned<br \/>\nadvocate for the respondents-accused, the learned trial Judge came to<br \/>\nthe conclusion that the prosecution has failed to prove the charge<br \/>\nlevelled against the respondents-accused and, therefore, acquitted<br \/>\nthem.\n<\/p>\n<p>3.\t\tBeing<br \/>\naggrieved by the aforesaid decision, the petitioner has preferred<br \/>\nthis Revision Application.\n<\/p>\n<p>4.\t\tMs.J.C.Bhatt,<br \/>\nlearned advocate for the petitioner, was absent in all the calls. I<br \/>\nhave heard Ms.F.D.Patel, learned Additional Public Prosecutor for the<br \/>\nState and also perused the Record &amp; Proceedings of the trial<br \/>\nCourt.\n<\/p>\n<p>5.\t\tIt<br \/>\nmay be recorded that State has not preferred any appeal against the<br \/>\nimpugned judgment.\n<\/p>\n<p>6.\t\tIt<br \/>\nappears from the evidence of P.W.-7 Bharatbhai Sidibhai recorded at<br \/>\nExhibit 27 that he took over the investigation of I-C.R.No.115 of<br \/>\n1993 from P.W.-6 Dhanjibhai (Exhibit-19) on 09.04.1993 and recorded<br \/>\nthe complaint of Jyotikaben and it was forwarded with report Exhibit<br \/>\n28 to register an offence against the respondents-accused. The<br \/>\nprosecution has produced the report at Exhibit 28. It appears from<br \/>\nthe report that the offence was disclosed by Jyotikaben at 16-15<br \/>\nhours on 09.04.1993 for the incident that occurred on 05.04.1993 at<br \/>\n14-30 hours. The prosecution has not produced the complaint allegedly<br \/>\nrecorded by P.W.-7 Bharat on 09.04.1993. Therefore, the prosecution<br \/>\ncase with regard to lodging of the complaint by Jyotikaben and<br \/>\ninvolvement of the respondents-accused could not be believed.\n<\/p>\n<p>7.\t\tThe<br \/>\nprosecution produced dying declaration of Jyotikaben at Exhibit 24.<br \/>\nIt appears that it was recorded on 05.04.1993 between 9.15 P.M. And<br \/>\n9.40 P.M. It indicates that the deceased herself poured kerosene from<br \/>\nthe container and set her on fire. It does not indicate that the<br \/>\nrespondents-accused played any role in setting her on fire.<br \/>\nTherefore, there are material contradictions in the prosecution<br \/>\nevidence and it would not be safe to rely upon such evidence to<br \/>\nconnect the respondents-accused.\n<\/p>\n<p>8.\t\tIt<br \/>\nappears from the evidence of P.W.-6 Dhanjibhai that he recorded<br \/>\nstatement of Jyotikaben during the investigation. The trial Court has<br \/>\nadmitted the statement of Jyotikaben in evidence by giving Exhibit\n<\/p>\n<p>21. As the statement was recorded during the course of investigation<br \/>\nin the offence registered as I-C.R.No.115 of 1993, it could not have<br \/>\nbeen admitted in evidence. Therefore, the statement could not be<br \/>\nrelied upon to connect the respondents-accused in the offence<br \/>\nregistered as I-C.R.No.125 of 1993.\n<\/p>\n<p>9.\t\tThe<br \/>\nprosecution has examined P.W.-1, Nandaben Bhagvandas, at Exhibit 12<br \/>\nand P.W.-3 Shantaram Balvantray at Exhibit-14. The evidence of<br \/>\nP.W.-1, Nandaben, indicates that the respondents-accused were beating<br \/>\nthe deceased. However, this evidence is contrary to dying declaration<br \/>\nExhibit 24. The evidence of P.W.-3 Shantaram indicates that he was<br \/>\nnot present at the time of the incident, but came to know about the<br \/>\nincident through his elder brother Kantinath. According to him, when<br \/>\nhe went to see Jyotikaben in hospital, she told him that the<br \/>\nrespondents-accused had picked up quarrel, attacked her and set her<br \/>\non fire. This evidence is also contrary to the dying declaration ?<br \/>\nExhibit 24.  Therefore, the prosecution case does not inspire<br \/>\nconfidence and the respondents-accused could not be implicated on the<br \/>\nbasis of such a weak piece of evidence.\n<\/p>\n<p>10.\t\tThe<br \/>\nprosecution also examined P.W.-5 Dr. Vijaybhai Rajnikant Shah at<br \/>\nExhibit 17. The witness has performed postmortem on the dead body of<br \/>\nthe deceased. The prosecution also produced P.M. Note at Exhibit 18.<br \/>\nBoth these evidence do not implicate the respondents-accused.\n<\/p>\n<p>11.\t\tIn<br \/>\nview of the above, there is not a single evidence to indicate that<br \/>\nthe respondents-accused were involved in the offence and were<br \/>\nresponsible for death of Jyotikaben. It also appears that according<br \/>\nto the prosecution case, the respondents-accused had committed<br \/>\ntrespass, caught hold of Jyotikaben, dragged her to kitchen, poured<br \/>\nkerosene and set her on fire. The evidence of P.W.-1 does not<br \/>\nindicate that she witnessed the incident of setting the deceased on<br \/>\nfire by the respondents-accused. There is no evidence to indicate<br \/>\nthat the respondents-accused committed trespass, dragged her to<br \/>\nkitchen, caught hold of her and set her on fire. The evidence of<br \/>\ndying declaration of Jyotikaben is contrary to the prosecution case.<br \/>\nTherefore, there is no independent, direct, reliable and convincing<br \/>\nevidence indicating involvement of the respondents-accused.\n<\/p>\n<p>12.\t\tIt is settled<br \/>\nproposition that an order of acquittal passed by a trial Court should<br \/>\nbe sparingly interfered with by the High Court in its revisional<br \/>\njurisdiction. The interference with the order passed by the trial<br \/>\nCourt is limited only to exceptional cases when it is found that the<br \/>\norder under revision suffers from glaring illegality or has caused<br \/>\nmiscarriage of justice or when it is found that the trial Court has<br \/>\noverlooked material evidence. Therefore, ordinarily, it would not be<br \/>\nappropriate for the High Court to reappreciate the evidence and come<br \/>\nto its own conclusion on the same when the evidence has already been<br \/>\nappreciated by the trial Court unless glaring feature is brought to<br \/>\nthe notice of the High Court which would otherwise tantamount to<br \/>\ngross miscarriage of justice. Therefore, the High Court in its<br \/>\nrevisional power does not ordinarily interfere with judgment of<br \/>\nacquittal passed by the trial Court unless there has been manifest<br \/>\nerror of law or procedure.\n<\/p>\n<p>13.\t\tIn the case on<br \/>\nhand, the petitioner has failed to point out that there is glaring<br \/>\nillegality or that the trial Court has overlooked the material<br \/>\nevidence. It is also not indicated that there is manifest error of<br \/>\nlaw or procedure.\n<\/p>\n<p>14.\t\tIn<br \/>\nview of the above, no interference is warranted in the impugned<br \/>\njudgment. Therefore, this Revision Application fails and stands<br \/>\ndismissed. R &amp; P be sent back to the trial Court.\n<\/p>\n<p>[Bankim<br \/>\nN.
