That on 31.10.2005, when deceased Silvester D’

Manjeshwara, in a motorcycle bearing.~~regis_tr;ation<\/p>\n
No.KA–19–S–916 as a pillion rider  n\u00a2ar <\/p>\n
Thokkottu overbridge, a bus}: bear1’ng”‘.cregistrationwe,i\\I.o. l<\/p>\n
KL-14–E–37-47 came fronagtheir   <\/p>\n
negligent manner and   niotor cycle,
\nas a result, deceasefdffell gggand\ufb02wlheel of the
\nbus passed over hisvAl.1ead:;.  ‘he was taken to
\nGovernment   and on the
\nway   and sisters filed a
\nclairrr  MACT, Mangalore, seeking
\ncompensation –. The Tribunal by<\/p>\n
inipjtigned  and award has awarded<\/p>\n
 can1pelrrsation__of Rs.2,10,000\/– with interest at 6% p.a.<\/p>\n
5   is no dispute regarding death of deceased<\/p>\n
 Silvesteri’ D’ Souza in a road traffic accident, negligence<\/p>\n

Whether the quantum of

and perusing the award of the  b<\/p>\n
View that the cornpensatiponawar’dVe’d by  <\/p>\n
not just and proper, it is onvdvd\u00e9thde lower side’  therefore<\/p>\n
it is deserved to be eriI’i\u00ab-anc\u00a7ed;5_ :  ” _<\/p>\n
7. Deceaised;  aged about 24
\nyears as:  tnortem report EX. P 2.\n<\/p>\n
  ‘o\ufb02i’\u00e9’._’t1’iei\u00a7r contention that the
\ndeceased yvas: .1-~4.,OOO\/– p.m. by Working as a<\/p>\n
driver in fishing b’oat”have examined the mother of the<\/p>\n
  deeeaS’ed as PV’V”1″;”’empIoyer of the deceased as PW 3,<\/p>\n
   not produced any document to show<\/p>\n
that  the owner of a \ufb01shing boat and he was<\/p>\n
 paying…i2s.I4,000\/~ as salary to the deceased, except<\/p>\n
 –..prod’ucing salary certi\ufb01cate Ex. P 7. Considering the<\/p>\n
 of the deceased as 24 years, year of accident<\/p>\n
as 2005 his income could easiiy be assessed at<\/p>\n
$4<\/p>\n
Rs\/1,000\/– pm. as against Rs.3,000\/– assessed by the
\nTribunal. Father of the deceased died during the<\/p>\n
pendency of the claimant petition. The <\/p>\n
of the deceased cannot be treated as V’<\/p>\n
