Adv.Sri.P.V.Kunhikrishnan, Standing Counsel takes<\/p>\n<p>notice for 2nd respondent.\n<\/p>\n<\/p>\n<p>      Having regard to the fact that the petitioner does not dispute<\/p>\n<p>that he availed the loan, the impugned action cannot be found<\/p>\n<p>fault with on account of any jurisdictional error or legal infirmity.<\/p>\n<p>However, having regard to the facts, it is directed that the recovery<\/p>\n<p>proceedings against the petitioner following Ext.P2 will stand<\/p>\n<p>suspended if the petitioner remits an amount of Rs.10,000\/- per<\/p>\n<p>month payable on or before 10th of every month commencing from<\/p>\n<p>March 2008. If there is default in remitting any of the instalments,<\/p>\n<p>the benefit of this judgment will stand recalled automatically. If the<\/p>\n<p>petitioner requests for any ameliorative benefits of reduction of<\/p>\n<p>interest etc., the 2nd respondent will look into such request and<\/p>\n<p>WPC No. 6638 OF 2008<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>take a decision as may be available in accordance with law and<\/p>\n<p>the total outstandings will thus stand guided by such decision.<\/p>\n<p>                              THOTTATHIL B.
