The Cantonment Board has the right to direct\t the\ndemolition  of\tsuch  structures under s.  187,\t within\t the\nperiod\tof  limitation for suits for  possession  of  public\nstreets or roads, that is, within 30 years from the date  of\nencroachment.\nIn the present case, the owner of a shop constructed a stone\nprojection over the drain belonging to the Cantonment Board,\nafter  obtaining  permission  of the  Cantonment  Board,  to\nfacilitate approach to his shop.  But, without obtaining the\npermission of the Cantonment Board, he put up a kiosk on the\nstone  projection  , which thus encroached  upon  the  drain\nbelonging  to  the Cantonment Board.   The  Board,  eighteen\nyears  after the construction, directed the removal  of\t the\nkiosk under S. 187.\nOn the question whether s. 185 or s. 187 applied.\nHELD  :\t The act complained of fell within the scope  of  s.\n187,  because, the permission given by the Board to  put  up\nthe stone projection did not confer on the owner of the shop\nany  proprietary right over the drain but merely gave him  a\nlicence.   As  the action of the Board was within  30  years\nfrom  the date of encroachment, the Board was  competent  to\nget the kiosk removed. Bhardwaj, for respondent No. 2.\n<\/p>\n<p>The Judgment of the Court was delivered by<br \/>\nHegde  J.,, The only question arising for decision  in\tthis<br \/>\nappeal\tby special leave is whether the notices impugned  in<br \/>\nthese pro-\n<\/p>\n<p><span class=\"hidden_text\">241<\/span><\/p>\n<p>ceedings  are  governed\t by s. 185(1) or s.  187(1)  of\t the<br \/>\nCantonments Act, 1924.\tThe trial court held that s. 185 (1)<br \/>\nis  the\t governing  provision.\tThe  first  appellate  court<br \/>\ndiffered from it. and held that s. 187(1) governs.  The High<br \/>\nCourt  in  second appeal has restored the  decision  of\t the<br \/>\ntrial court.\n<\/p>\n<p>The  respondent\t is  the owner of shop No.  344\t in  Mohalla<br \/>\nBakri, Lal-Kurti Bazar, Meerut Cantt.  The shop in  question<br \/>\nwas constructed about 20 years before the institution of the<br \/>\nsuit  from which this appeal arises.  At about the  time  of<br \/>\nthe  construction of that shop permission was obtained\tfrom<br \/>\nthe Cantonment Board to put up, a stone projection over\t the<br \/>\ndrain  by  the\tside of the Toad in front  of  the  shop  to<br \/>\nfacilitate ingress into the shop and egress therefrom.\t The<br \/>\nfirst  appellate court has found and that finding  has\tbeen<br \/>\naccepted by the High Court that about 18 years prior to\t the<br \/>\ninstitution  of\t the suit, the owner of the shop, put  up  a<br \/>\nwooden kiosk over the stone projection and the same is being<br \/>\nused  as  a  pan shop.\tAccording to the  finding  of  those<br \/>\ncourts\tthe kiosk in question was put up  without  obtaining<br \/>\nthe  permission\t of the Cantonment Board.   On\tNovember  9,<br \/>\n1953,  the Cantonment Board issued a notice to the  occupier<br \/>\nof shop No. 344 under s. 187, requiring him to demolish\t and<br \/>\nremove\tthe  kiosk within 7 days from the  receipt  of\tthat<br \/>\nnotice.\t  As  that  demand was not complied  with,  a  final<br \/>\nnotice\tunder s. 187 was -given to him on December 8,  1953.<br \/>\nThereafter  the owner of&#8217; the shop instituted the suit\tfrom<br \/>\nwhich this appeal has arisen seeking a perpetual  injunction<br \/>\nrestraining  the  Cantonment Board from, getting  the  kiosk<br \/>\nremoved.  As mentioned earlier, the trial court decreed\t the<br \/>\nsuit  holding  that as the kiosk had been put  up  18  years<br \/>\nprior  to the issue of the notices referred to earlier,\t the<br \/>\nCantonment  Board  cannot compel its removal in view  of  s.<br \/>\n185(1).\t This decision was reversed by the learned  District<br \/>\nJudge  in. appeal.  The learned District Judge accepted\t the<br \/>\nfinding\t of the trial court that the kiosk in  question\t had<br \/>\nbeen  put up about 18, years prior to the date of  the\tsuit<br \/>\nbut yet according to him it was competent for the Cantonment<br \/>\nBoard to get the same removed under s. 187(1).\tThe  learned<br \/>\nDistrict Judge opined that s. 1 85 (1 ) has no relevance  to<br \/>\nthe  facts  of the case.  In second appeal. the\t High  Court<br \/>\nagreed\twith  the  conclusion of the trial.  court  that  s.<br \/>\n185(1) is the governing provision.\n<\/p>\n<p>The established facts are :&#8211;Shop No. 344 was constructed on<br \/>\nthe land belonging to the respondent.  Cantonment Board had&#8217;<br \/>\nno  right  in or over that land.  The stone  projection\t was<br \/>\nconstructed   over  the\t drain\tadjoining  the\troad   after<br \/>\nobtaining the permission of the Cantonment Board.  It cannot<br \/>\nbe  disputed  that the. property in the road  including\t the<br \/>\ndrain  statutorily  vests  in  the  Cantonment\tBoard.\t The<br \/>\npermission,  given by the Cantonment Board to the  owner  of<br \/>\nthe shop to put up the projec-\n<\/p>\n<p><span class=\"hidden_text\">242<\/span><\/p>\n<p>tion  does not confer on him any proprietary right over\t the<br \/>\ndrain. It merely gives him a licence to use the\t projection.<br \/>\nHe  cannot  exclude the public from using  that\t projection.<br \/>\nThe  kiosk had been put up without obtaining the  permission<br \/>\nof  the Cantonment Board.  The kiosk is a structure  and  it<br \/>\nprojects  or  encroaches  upon the drain  belonging  to\t the<br \/>\nCantonment  Board.  It can even .be said that  it  overhangs<br \/>\nthe  drain.   We have now to examine ,the provision  of\t law<br \/>\napplicable bearing in mind those facts.<br \/>\nSection 185(1) reads :\n<\/p>\n<blockquote><p>\t      &#8220;A  (Board)  may, at any time,  by  notice  in<br \/>\n\t      writing  direct the owner, lessee or  occupier<br \/>\n\t      of  any  land in the cantonment  to  stop\t the<br \/>\n\t      erection\tor re-erection of a building in\t any<br \/>\n\t      case in which the (Board) considers that\tsuch<br \/>\n\t      erection\tor re-erection is an  offence  under<br \/>\n\t      section  184, and may in such case (or in\t any<br \/>\n\t      other  case in which the Board considers\tthat<br \/>\n\t      the  erection or re-erection of a building  is<br \/>\n\t      an  offence  under  S.  184,  within   (twelve<br \/>\n\t      months) of the completion of such erection  or<br \/>\n\t      re-erection)   in\t like  manner  direct\tthe-<br \/>\n\t      alteration   or\tdemolition  as\t it   thinks<br \/>\n\t      necessary,   of  the  building  or  any\tpart<br \/>\n\t      thereof, so erected or re-erected.&#8221;\n<\/p><\/blockquote>\n<p>We are unable to agree with the High Court that this section<br \/>\napplies\t to the facts of the present case.  In our  judgment<br \/>\nthat  section  applies\tonly to cases where  a\tbuilding  is<br \/>\nerected or reerected over a land belonging to someone  other<br \/>\nthan  the Cantonment Board.  That is why that  section\tsays<br \/>\nthat  a notice under that section can be given &#8220;to a  owner,<br \/>\nlessee\tor  &#8216;Occupier  of any land&#8221;.  A\t notice\t under\tthat<br \/>\nsection\t cannot be given to any person other than the  owner<br \/>\nor  lessee  or\tthe  occupier of the  land  over  which\t the<br \/>\nbuilding  in question had been erected or  re-erected.\t The<br \/>\nnotices\t with which we are concerned in this case  were\t not<br \/>\ngiven  to  the owner, lessee or occupier of  the  land\tover<br \/>\nwhich  kiosk is put up.\t As seen earlier the kiosk has\tbeen<br \/>\nconstructed  over  the\tland  under  the  ownership  of\t the<br \/>\nCantonment Board.  Neither the owner of shop No. 344 or\t its<br \/>\noccupier  can  be considered as a lessee of  the  land\tover<br \/>\nwhich  the  projection was put -up.   Hence  the  provisions<br \/>\ncontained  in  s. 185(1) are not attracted  to\tthe  present<br \/>\ncase.\n<\/p>\n<p>\t      This&#8217; takes us to s. 187(1).  It reads<br \/>\n\t      &#8221;\t No owner or occupier of any building  in  a<br \/>\n\t      cantonment  shall, without the  permission  in<br \/>\n\t      writing of the<br \/>\n\t      the  (Board)  add to or place  against  or  in<br \/>\n\t      front  of\t the  building\tany  projection\t  or<br \/>\n\t      structure\t overhanging,  projecting  into,  or<br \/>\n\t      encroaching on, any street or any drain, sewer<br \/>\n\t      or aqueduct therein&#8221;.\n<\/p>\n<p><span class=\"hidden_text\">\t\t\t    243<\/span><\/p>\n<p>This section deals with constructions which are\t projections<br \/>\nor structures overhanging, projecting into or encroaching on<br \/>\nany street or any drain, sewer or aqueduct.  Undoubtedly the<br \/>\nkiosk  is  structure.\tFurther it is a\t projection  into  a<br \/>\ndrain.\tIt also encroaches on the drain if it does not\talso<br \/>\noverhang it.  Therefore the act complained of clearly  falls<br \/>\nwithin the scope of s. 187(1),<br \/>\n In other words s. 185 deals with erection or re-erection of<br \/>\nbuildings  on  private lands whereas s. 187 deals  with\t the<br \/>\nconstruction  of  projections  or  structures\toverhanging,<br \/>\nprojecting  into or encroaching on any street, any drain  or<br \/>\naqueduct.      The     two     provisions     deal\twith<br \/>\ndifferent.situations. One ha$ nothing to do with the  other.<br \/>\nObviously the legislature does not want the Cantonment Board<br \/>\nto  demolish  buildings erected on private lands  after\t the<br \/>\nperiod\tmentioned in s. 185(1) but public interest  requires<br \/>\nthat  no such limitation should be placed on the  Cantonment<br \/>\nBoard  while acting under s. 187(1).  Otherwise our  streets<br \/>\nand  roads  may soon disappear.\t The High Court\t missed\t the<br \/>\ndistinction between s. 185(1) and s. 187(1).  Quite  clearly<br \/>\nthe present case falls within s. 187(1).<br \/>\n\tJudicial opinion is divided on the question  whether<br \/>\nlocal Boards can take action under provisions similar to  s.<br \/>\n187 even after the period of limitation for filing suits  by<br \/>\nthose  bodies for possession of public streets or  roads  or<br \/>\nparts  thereof\tor  on which they  have\t discontinued  their<br \/>\npossession,  expires.  It is not necessary to go  into\tthat<br \/>\ncontroversy  in the present case.  The period of  limitation<br \/>\nprescribed for a suit of the type referred to earlier is  30<br \/>\nyears.\t In  the  present case action under  s.\t 187(1)\t had<br \/>\nbeen  .commenced  within  18  years from  the  date  of\t the<br \/>\nencroachment.\n<\/p>\n<p>For  the reasons mentioned above this appeal is allowed\t and<br \/>\ndecree of the High Court is set aside and that of the  first<br \/>\nappellate court restored.\n<\/p>\n<p>Now coming to the question of costs, at the time of granting<br \/>\nspecial\t leave\tthis Court had directed that  the  appellant<br \/>\nshall  pay.  the costs of the respondent in any\t event.\t  We<br \/>\nincorporate that order as a part of this judgment.<br \/>\n&#8220;I<br \/>\nV.P.S.\n<\/p>\n<p>\t\t      Appeal allowed.\n<\/p>\n<p><span class=\"hidden_text\">244<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Cantonment Board, Meerut vs Naraindas &amp; Anr on 9 April, 1969 Equivalent citations: 1970 AIR 105, 1970 SCR (1) 240 Author: K Hegde Bench: Hegde, K.S.
