The petitioner  in  O.P.No.5686\/01  claimed<br \/>\n          the  post  of  Headmistress  of  Mannam  Memorial  High<br \/>\n          School, Vilakkudy, Punalur, as she was overlooked.  The<br \/>\n          manager appointed the petitioner in O.P.No.31697\/02  in<br \/>\n          that post.    There were several litigations concerning<br \/>\n          the matter including disciplinary  action  against  the<br \/>\n          petitioner in  O.P.NO.5686\/01.    Finally,  based  on a<br \/>\n          direction from this court, the Manager the appellant in<br \/>\n          W.A.No.2157\/03 considered her claim and  passed  Ext.P9<br \/>\n          marked  in  O.P.No.5686\/01 to the effect that, as there<br \/>\n          was  disciplinary  action  and  criminal  case  pending<br \/>\n          against  her,  she  could  not  have  been appointed as<br \/>\n          Headmistress.  Consequently, Ext.P10 order  was  issued<br \/>\n          by the Manager appointing an enquiry officer to hold an<br \/>\n          enquiry against her.  Earlier she had been placed under<br \/>\n          suspension and was later reinstated.\n<\/p>\n<p>          \t3.   During  the  pendency of the said original<br \/>\n          petition, her claim for the post  of  Headmistress  had<br \/>\n          been   finally   considered   and  adjudicated  by  the<br \/>\n          Government  as  is  revealed  by  Ext.P11   marked   in<br \/>\n          O.P.No.31697\/02.  Government, in that order, upheld the<br \/>\n          claim of  the petitioner in O.P.No.5686\/01.  That order<br \/>\n          was challenged by the appointee  &#8211;  the  petitioner  in<br \/>\n          O.P.No.31697\/02.   Therefore,  in the light of Ext.P11,<br \/>\n          there arises no question of considering  the  challenge<br \/>\n          against Ext.P9  marked  in  O.P.No.5686\/01.  It is also<br \/>\n          now agreed by the  counsel  on  either  side  that  the<br \/>\n          disciplinary  action  had  never been proceeded against<br \/>\n          the petitioner  in  O.P.No.5686\/01  and  that  she  had<br \/>\n          retired by now.  Therefore, there arises no question of<br \/>\n          considering the challenge against Ext.P10 as well.\n<\/p>\n<p>          \t4.    In   the   meantime,  Ext.P13  marked  in<br \/>\n          O.P.No.5686\/01  was  also  passed   by   the   District<br \/>\n          Educational Officer, Punalur, based on a direction from<br \/>\n          this  court,  regularising  the period during which she<br \/>\n          had been kept  under  suspension  and  treating  it  as<br \/>\n          eligible leave.  Though O.P.No.5686\/01 was not formally<br \/>\n          amended  incorporating  the  challenge  against Ext.P13<br \/>\n          order, it was produced and her grievance against it had<br \/>\n          been  voiced  in  an   affidavit   filed   along   with<br \/>\n          I.A.No.8121\/03.   That  much  is  sufficient as regards<br \/>\n          O.P.No.5686\/01 because, the main challenge was  against<br \/>\n          Ext.P11  marked  in  O.P.No.31697\/02 at the instance of<br \/>\n          the appointee for the post of Headmaster, the appellant<br \/>\n          in W.A.No.1623\/03 and 2051\/03.\n<\/p>\n<p>          \t5.  The bone of contention is who  among  these<br \/>\n          two  should  have  been  considered  for the vacancy of<br \/>\n          Headmaster, which  arose  on  retirement  of  the  then<br \/>\n          incumbent.     The   claim   of   the   petitioner   in<br \/>\n          O.P.No.5686\/01 was  resisted  mainly  based  on  Ext.P8<br \/>\n          marked  in  O.P.No.31697\/02  which is, according to the<br \/>\n          appointee as well as the Manager, a consent obtained as<br \/>\n          provided in the Note under rule  44(1)  Chapter  XIV  A<br \/>\n          K.E.R.    to  appoint  a  junior  incumbent  viz.,  the<br \/>\n          petitioner  in  O.P.No.31697\/02   (the   appellant   in<br \/>\n          W.A.Nos.1623\/03  and 2051\/03) So everything depend upon<br \/>\n          the legal efficacy of Ext.P8.\n<\/p>\n<p>          \t6.     Admittedly,    the     petitioner     in<br \/>\n          O.P.No.5686\/01  was  the  seniormost  incumbent  in the<br \/>\n          school when the vacancy arose on 1.5.1996.  There is no<br \/>\n          contention that she had not been qualified.  Rule 44(1)<br \/>\n          Chapter XIV A of the Kerala Education Rules obliges the<br \/>\n          Manager,  while  making  appointment  to  the  post  of<br \/>\n          Headmaster,  to  follow the seniority of the incumbents<br \/>\n          concerned, ordinarily.  Of course, going  by  the  Note<br \/>\n          under Sub-rule (1) of Rule 44, the Manager can prefer a<br \/>\n          junior   incumbent   provided,   the  senior  incumbent<br \/>\n          consents for that.  Therefore, appointment of a  junior<br \/>\n          incumbent can be made only after obtaining consent from<br \/>\n          the seniormost  eligible  incumbent.   The Note further<br \/>\n          provides that &#8220;such consent shall have the approval  of<br \/>\n          the Educational  Officer concerned&#8221;.  Thus consent is a<br \/>\n          pre-requisite to  prefer  a  junior  incumbent.    Such<br \/>\n          consent shall  be  an efficacious one.  It shall always<br \/>\n          have the  approval.    Then  alone  it   will   be   an<br \/>\n          efficacious consent.    Therefore, such approval to the<br \/>\n          consent is a pre-requisite, so far as  the  Manager  is<br \/>\n          concerned, to  overlook  the  seniority.  Ext.P8 is the<br \/>\n          consent  in  this  case,  whereby  the  petitioner   in<br \/>\n          O.P.No.5686\/01  had  allegedly  renounced her claim for<br \/>\n          appointment as Headmistress.  But no  one  has  a  case<br \/>\n          before us that any approval to the said alleged consent<br \/>\n          dated 29.6.1996 had been obtained until the junior hand<br \/>\n          had  been  appointed  as Headmaster as per Ext.P5 dated<br \/>\n          2.9.1996 marked in O.P.No.31697\/02.  When  the  statute<br \/>\n          requires  that  there  shall be a such consent and that<br \/>\n          consent shall have  the  approval  of  the  Educational<br \/>\n          Officer,  necessarily,  it  is  a pre-requisite for the<br \/>\n          Manager to prefer a junior incumbent.   When  a  junior<br \/>\n          incumbent   was   thus  preferred  for  appointment  as<br \/>\n          Headmaster as per Ext.P5 dated  2.9.1996,  approval  to<br \/>\n          such consent  had  not  been  obtained.  Even on today,<br \/>\n          there is no approval.  Therefore,  the  appointment  of<br \/>\n          the  petitioner  in  O.P.No.31697\/02,  the appellant in<br \/>\n          W.A.No.1623\/03 and in W.A.No.2051\/03 as headmaster  was<br \/>\n          not in  order.    In  such circumstances, the challenge<br \/>\n          against Ext.P11 at his instance was rightly turned down<br \/>\n          by the learned single Judge.  Necessarily, the impugned<br \/>\n          judgment has to be sustained.\n<\/p>\n<p>          \t7.  The learned single Judge also  had  quashed<br \/>\n          Ext.P13  order  produced  in O.P.No.5686\/01 whereby the<br \/>\n          period of suspension of the petitioner therein had been<br \/>\n          regularised as eligible  leave.    When  there  was  no<br \/>\n          disciplinary  action  finding her guilty and when there<br \/>\n          was no permission granted by the Educational Officer to<br \/>\n          keep the incumbent under  suspension  beyond  15  days,<br \/>\n          necessarily,  the District Educational Officer, Punalur<br \/>\n          was not justified in treating the suspension period  as<br \/>\n          eligible leave.     Rule  67(8)  Chapter  XIV-A  K.E.R.<br \/>\n          provides that if the Educational Officer &#8220;is  satisfied<br \/>\n.PL 62<br \/>\n          that  there  was no valid ground for the suspension, he<br \/>\n          may direct the manager to reinstate  the  teacher  with<br \/>\n          effect from  the date of suspension &#8230;..&#8221;.  Therefore,<br \/>\n          interference with Ext.P13 as per the impugned  judgment<br \/>\n          is also to be sustained.\n<\/p>\n<p>          \t8.  We need not consider the contention of  the<br \/>\n          Manager,  the  appellant  in W.A.No.1623\/03, that there<br \/>\n          was no formal challenge against Ext.P13  because,  none<br \/>\n          of the rights of appellant is adversely affected by it.<br \/>\n          He  was  on  any  count,  going by Rule 67(8) liable to<br \/>\n          reinstate the teacher.  He did not do so.   The  salary<br \/>\n          paid  to  the  teacher  on  account  of  his refusal to<br \/>\n          reinstate the teacher is to be recouped from him as per<br \/>\n          law.\n<\/p>\n<p>          \t9.  Anyhow, as the petitioner in O.P.No.5686\/01<br \/>\n          is getting the benefit with  retrospective  effect,  we<br \/>\n          find that the award of costs shall be set aside.
