Heard Shri Jai Prakash Singh, learned<\/p>\n<p>                 counsel appearing on behalf of the petitioner<\/p>\n<p>                 and Smt. Indu Bala Pandey, learned Additional<\/p>\n<p>                 Public Prosecutor appearing on behalf of the<\/p>\n<p>                 State.\n<\/p>\n<p>                            The petitioner, who is informant in<\/p>\n<p>                 Halsi    P.S.     Case    No.18      of    2008    registered<\/p>\n<p>                 under Sections 364, 384, 386, 120 B\/34 of the<\/p>\n<p>                 Indian Penal Code, has prayed for quashing of<\/p>\n<p>                 order    dated    22.2.2008         passed    by   Additional<\/p>\n<p>                 Chief Judicial Magistrate, Lakhisarai to the<\/p>\n<p>                 extent whereby the learned Magistrate has set<\/p>\n<p>                 the     victim     girl     at      liberty      and   learned<\/p>\n<p>                 Magistrate has not accepted the plea of the<\/p>\n<p>                 petitioner that the victim girl may be handed<\/p>\n<p>                 over to the informant-petitioner.<\/p>\n<p>                            Learned      counsel      for   the     petitioner,<\/p>\n<p>                 while pressing the present petition, submits<\/p>\n<p>                 that the victim girl, who is daughter of the<\/p>\n<p>                 informant, was on the date of passing of the<\/p>\n<p>                 impugned       order,    was     minor.    Learned     counsel<\/p>\n<p>                 has     also     referred      to     Annexure-4       to   the<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>petition, which is a copy of School Leaving<\/p>\n<p>Certificate in which the date of birth has<\/p>\n<p>been    mentioned        as       30.12.1993.      It     has   been<\/p>\n<p>submitted that on the date of the impugned<\/p>\n<p>order, the victim girl was aged 15 years and,<\/p>\n<p>accordingly, the learned Magistrate was not<\/p>\n<p>required       to       release          the     victim       without<\/p>\n<p>handing over her custody to the informant.<\/p>\n<p>             Besides     hearing         learned    counsel       for<\/p>\n<p>the    parties,          I        have    also     perused       the<\/p>\n<p>materials available on record. The petitioner<\/p>\n<p>has    brought      a   copy       of    statement       of   victim<\/p>\n<p>girl recorded under Section 164 of the Code<\/p>\n<p>of Criminal Procedure in which the victim had<\/p>\n<p>disclosed her age as 21 years. Annexure-2A is<\/p>\n<p>the copy of medical report which shows that<\/p>\n<p>during    the    medical           examination,         the    victim<\/p>\n<p>was found as 21 years old. Perusal of the<\/p>\n<p>impugned       order          shows       that     the        learned<\/p>\n<p>Magistrate,         after          examining       the        medical<\/p>\n<p>report as well as considering the age of the<\/p>\n<p>victim       recorded         in        her    statement        under<\/p>\n<p>Section       164       of        the     Code     of     Criminal<\/p>\n<p>Procedure, has passed the impugned order and<\/p>\n<p>set    the    victim         at    liberty     without        handing<\/p>\n<p>over her custody to the informant.<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>                  This   Court   is   satisfied    that   while<\/p>\n<p>        passing    the   impugned     order,      the   learned<\/p>\n<p>        Magistrate       has     committed        no      error.<\/p>\n<p>        Accordingly, the petition stands rejected.<\/p>\n<p>                                         ( Rakesh Kumar,J.)<br \/>\nN.H.\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Shanti Devi vs State Of Bihar on 1 July, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
