In para-10(B) interim relief<br \/>\nhas been prayed to stay further operation and implementation of order<br \/>\ndated 23\/9\/1988 Annexure-A and order dated 30\/12\/1996 Annexure-B.<br \/>\nAccordingly, this Court has passed following order on 6\/2\/1997<br \/>\nadmitting the matter:\n<\/p>\n<p>&#8220;Rule.\n<\/p>\n<p>To<br \/>\nbe heard with Spl. C. A. No.2872 of 1996.  Ad interim relief in terms<br \/>\nof para-10(B).  Notice as to interim relief returnable on 17th<br \/>\nFebruary, 1997.  D. S. permitted.&#8221;\n<\/p>\n<p>3.\tThereafter<br \/>\nad interim relief which has been granted ex parte is confirmed by<br \/>\nthis Court on 4\/3\/1997 till present Special Civil Application is<br \/>\nfinally decided by this Court.  The Special Civil Application No.2872<br \/>\nof 1996 which is to be heard along with present Special Civil<br \/>\nApplication has been disposed of only on ground that petitioner no.1<br \/>\nof that petition has expired and though notice has been served to<br \/>\npetitioner nos.2 to 4 of that petition, they remained absent and none<br \/>\nappears on behalf of petitioners.  Therefore, that petition was<br \/>\ndisposed of and rule has been discharged and interim relief has been<br \/>\nstands vacated.\n<\/p>\n<p>4.\tLearned<br \/>\nadvocate Mr. Chirag Patel raised contention before this Court that<br \/>\naffidavit-in-reply has been filed by respondent competent authority<br \/>\nunder Land Ceiling Act and Additional Collector Shri Ashok Mehta on<br \/>\n20\/11\/2010 wherein he relied upon averments made in para-5 of said<br \/>\nreply which is quoted as under:\n<\/p>\n<p>\t&#8220;I<br \/>\nrespectfully say that notification under section 10(1) was prepared<br \/>\nand published on 15.10.1988 and no further proceedings after 10(1)<br \/>\nhave been carried out.  I further say that the petitioner had<br \/>\napproached the Urban Land Tribunal against the order of the competent<br \/>\nauthority dated 23.09.1988 which came to be rejected by the Tribunal<br \/>\non 30.12.1996, against which the petitioner has preferred the<br \/>\ncaptioned writ petition.  I further say that this Hon&#8217;ble Court<br \/>\n(Coram: Hon&#8217;ble Mr. Justice S. D. Dave) vide order dated 06.02.1997<br \/>\nhad issued Rule as well as granted ad interim relief in terms of para<br \/>\n10(B).  A copy of the order dated 06.02.1997 is annexed hereto and<br \/>\nmarked as Annexure-VI to this affidavit.&#8221;\n<\/p>\n<p>5.\tLearned<br \/>\nadvocate Mr. Chirag Patel submitted that during the pendency of this<br \/>\npetition, considering the provisions under old Act, the Urban Land<br \/>\n(Ceiling and Regulation) Act, 1976, no further proceedings have been<br \/>\ninitiated by respondent authority under Section-10 Sub-Section-3.<br \/>\nRelevant Section of old Act Repeal Act Section-10 Sub Section 1 to 6<br \/>\nare quoted as under:\n<\/p>\n<p>&#8220;10.\n<\/p>\n<p>Acquisition of vacant land in excess of ceiling limit.-\n<\/p>\n<p><span class=\"hidden_text\">(1)<\/span><\/p>\n<p>As soon as may be after the service of the statement under section 9<br \/>\non the person concerned, the competent authority shall cause a<br \/>\nnotification giving the particulars of the vacant land held by such<br \/>\nperson in excess of the ceiling limit and stating that-\n<\/p>\n<p>such<br \/>\n\tvacant land is to be acquired by the concerned State Government; and<\/p>\n<p>the<br \/>\n\tclaims of all person interested in such vacant land may be made by<br \/>\n\tthem personally or by their agents giving particulars of the nature<br \/>\n\tof their interests in such land, to be published for the information<br \/>\n\tof the general public in the Official Gazette of the State concerned<br \/>\n\tand in such other manner as may be prescribed.\n<\/p>\n<p>(2)\tAfter<br \/>\n\tconsidering the claims of the persons interested in the vacant land,<br \/>\n\tmade to the competent authority in pursuance of the notification<br \/>\n\tpublished under sub-section (1), the competent authority shall<br \/>\n\tdetermine the nature and extent of such claims and pass such orders<br \/>\n\tas it deems fit.\n<\/p>\n<p>(3)\tAt<br \/>\n\tany time after the publication of the notification under sub-section<br \/>\n\t(1) the competent authority may, by notification published in the<br \/>\n\tOfficial Gazette of the State concerned, declare that the excess<br \/>\n\tvacant land referred to in the notification published under<br \/>\n\tsub-section (1) shall, with effect from such date as may be<br \/>\n\tspecified in the declaration, be deemed to have been acquired by the<br \/>\n\tState Government and upon the publication of such declaration, such<br \/>\n\tland shall be deemed to have vested absolutely in the State<br \/>\n\tGovernment free from all encumbrances with effect from the date so<br \/>\n\tspecified.\n<\/p>\n<p>(4)\tDuring<br \/>\n\tthe period commencing on the date of publication of the notification<br \/>\n\tunder sub-section (1) and ending with the date specified in the<br \/>\n\tdeclaration made under sub-section (3) &#8211;\n<\/p>\n<p>(i)\tno<br \/>\n\tperson shall transfer by way of sale, mortgage, gift, lease or<br \/>\n\totherwise any excess vacant land (including any part thereof)<br \/>\n\tspecified in the notification aforesaid and any such transfer made<br \/>\n\tin contravention of this provision shall be deemed to be null and<br \/>\n\tvoid; and <\/p>\n<p>(5)\twhere<br \/>\n\tany vacant land is vested in the State Government under sub-section<br \/>\n\t(3), the competent authority may, by notice in writing, order any<br \/>\n\tperson who may be in possession of it to surrender or deliver<br \/>\n\tpossession thereof to the State Government or to any person duly<br \/>\n\tauthorised by the State Government in this behalf within thirty days<br \/>\n\tof the service of the notice.\n<\/p>\n<p>(6)\tIf<br \/>\n\tany person refuses or fails to comply with an order made under<br \/>\n\tsub-section (5), the competent authority may take possession of the<br \/>\n\tvacant land or cause it to be given to the concerned State<br \/>\n\tGovernment or to any person duly authrorised by such State<br \/>\n\tGovernment in this behalf and may for that purpose use such force as<br \/>\n\tmay be necessary.\n<\/p>\n<p>Explanation:-In<br \/>\n\tthis section, in sub-section (1) of sec.11 and in sections 14 and<br \/>\n\t23, &#8220;State Government&#8221;, in relation to-\n<\/p>\n<p>(a)\tany<br \/>\n\tvacant land owned by the Central Government, means the Central<br \/>\n\tGovernment;\n<\/p>\n<p>(b)\tany<br \/>\n\tvacant land owned by any State Government and situated in the Union<br \/>\n\tterritory or within the local limits of a cantonment declared as<br \/>\n\tsuch under section 3 of the Cantonments Act, 1924, means that State<br \/>\n\tGovernment.&#8221;\n<\/p>\n<p>6.\tIn<br \/>\nview of aforesaid provisions of Repeal Act, after issuance of<br \/>\nnotification under Section-10(1), no further proceedings have been<br \/>\ninitiated by respondent authority and no notification has been issued<br \/>\nunder Section-10(3) and possession of excess vacant land referred in<br \/>\nSection-10(1) notification has not been acquired or taken by State<br \/>\nGovernment.  Therefore, land in question is not vested in the State<br \/>\nGovernment under Sub Section-3 because no such notification is issued<br \/>\nby respondent authority because of interim relief granted by this<br \/>\nCourt.\n<\/p>\n<p>7.\tLearned<br \/>\nadvocate Mr. Chirag Patel brought to the notice of this Court amended<br \/>\nAct, the Urban Land (Ceiling and Regulation) Repeal Act, 1999<br \/>\nSection-2, wherein the Urban Land Ceiling and Regulation, 1976 being<br \/>\na principal Act is hereby repealed which shall not effect certain<br \/>\ncontingency as describe in Section-3 and 4 of Repeal Act which is<br \/>\nquoted as under:\n<\/p>\n<p>&#8220;3.(1)<br \/>\nThe repeal of the principal Act shall not affect:-\n<\/p>\n<p>(a)\tthe<br \/>\nvesting of any vacant land under sub-section (3) of section 10,<br \/>\npossession of which has been taken over by the State Government in<br \/>\nthis behalf or the competent authority;\n<\/p>\n<p>(b)\tthe<br \/>\nvalidity of any order granting exemption under sub-section (1) of<br \/>\nsection 20 or any action taken there under, not withstanding any<br \/>\njudgment of any court to the contrary;\n<\/p>\n<p>(c)\tany<br \/>\npayment made To the State Government as a condition for granting<br \/>\nexemption under sub-section (1) of section 20.\n<\/p>\n<p>(2)\tWhere\n<\/p>\n<p>&#8211;\n<\/p>\n<p>(a)\tany<br \/>\nland  is deemed to have vested in the State Government under<br \/>\nsub-section (3) of Section 10 of the principal Act but possession of<br \/>\nwhich has not been taken over by the State Government or any person<br \/>\nduly authorized by the State Government in this behalf or by the<br \/>\ncompetent authority; and <\/p>\n<p>(b)\tany<br \/>\namount has been paid by the State government with respect to such<br \/>\nland, <\/p>\n<p>then,<br \/>\nsuch land shall not be restored unless the amount paid, if any, has<br \/>\nbeen refunded to the State Government.\n<\/p>\n<p>4.\tAll<br \/>\nproceedings relating to any order made or purported to be made under<br \/>\nthe principal Act pending immediately before the commencement of this<br \/>\nAct, before any court, tribunal or other authority shall abate:\n<\/p>\n<p>\tProvided<br \/>\nthat this section shall not apply to the proceedings relating to<br \/>\nsections 11, 12, 13 and 14 of the principal Act in so far as such<br \/>\nproceedings are relatable to the land, possession of which has been<br \/>\ntaken over by  the State Government or any person duly authorized by<br \/>\nthe State Government in this behalf or by the competent authority.&#8221;\n<\/p>\n<p>8.\tIn<br \/>\nview of aforesaid provisions made in Repeal Act, Section-3 Sub<br \/>\nSection-2 wherein land is deemed to have vested under Section 10(3)<br \/>\nof Principal Act but possession of which has not been taken over by<br \/>\nrespondent duly authorised by state government in this behalf or by<br \/>\ncompetent authority and all proceedings which are relating to any<br \/>\norder made or purported to be made under the principal Act pending<br \/>\nimmediately before the commencement of Repeal Act before any Court,<br \/>\nTribunal or other authority that shall abate but this is not made<br \/>\napplicable to proceedings relating to Section-11, 12, 13 and 14 of<br \/>\nPrincipal Act.\n<\/p>\n<p>9.\tIn<br \/>\nview of above provisions made in Repeal Act and fact finding as per<br \/>\naffidavit-in-reply of respondent authority as per averments made in<br \/>\npara-5 possession of land in question has not been taken over by<br \/>\nrespondent authority because no principal act Section-10 Sub<br \/>\nSection-3 notification is not at all issued and no further<br \/>\nproceedings has been initiated by respondent.  Therefore,<br \/>\naccordingly, present proceedings are abated as per Section-4 of<br \/>\nRepeal Act.  Rule is made absolute to the aforesaid extent.
