JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/04\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\npetition under Article 226 of the Constitution of India, has been<br \/>\nfiled with the following prayers:\n<\/p>\n<p> (A)\tBe<br \/>\npleased to admit this petition;\n<\/p>\n<p>(B)\tBe<br \/>\npleased to issue writ, order or direction, quashing and setting-aside<br \/>\nthe notice issued by the Corporation authorities dated 3.3.2010 as<br \/>\nwell as illegal and arbitrary action on the part of the Corporation<br \/>\nauthorities in deciding to construct 27 meters by-pass road<br \/>\n(proposed) and to lay water and drainage pipeline upon the land in<br \/>\nquestion of the petitioner without offering alternative piece of land<br \/>\nto the petitioner and without giving any compensation to the<br \/>\npetitioner;\n<\/p>\n<p>(C)\tBe<br \/>\npleased to issue appropriate writ, order or direction, directing the<br \/>\nCorporation authorities to decide the representation of the<br \/>\npetitioner and not to proceed with the further construction of<br \/>\nby-pass road and laying water and drainage pipeline upon the land in<br \/>\nquestion of the petitioner till the petitioner is allotted<br \/>\nalternative land in adjoining area in lieu of his original land which<br \/>\nis sought to be acquired for the purpose of constructing by-pass road<br \/>\n(proposed) and for laying water and drainage pipeline;\n<\/p>\n<p>(D)\tPending<br \/>\nadmission and till final disposal of this petition, be pleased to<br \/>\npass appropriate writ, order or direction restraining the Corporation<br \/>\nauthorities from putting up the construction of the by-pass road<br \/>\n(proposed) as well as from laying water and drainage pipeline upon<br \/>\nthe land in question of the petitioner till the aforesaid petition is<br \/>\nfinally heard and decided and to maintain status-quo in respect of<br \/>\nthe land in question of the petitioner till the aforesaid petition is<br \/>\nfinally heard and decided.\n<\/p>\n<p>(E)\tBe<br \/>\npleased to pass such other and further orders as may be deemed fit in<br \/>\nthe interest of justice;\n<\/p>\n<p>\tI<br \/>\nhave heard Mr.N.K.Majmudar, learned counsel for the petitioner. It is<br \/>\nsubmitted by him that the petitioner is an agriculturist and the<br \/>\nrespondent-authority is proposing to construct 27 meter wide by-pass<br \/>\nroad on land bearing revenue Survey No.829 Paiki 1, situated at Mouje<br \/>\nBapod, Taluka Vadodara, District: Vadodara, admeasuring 0 Hectare, 71<br \/>\nAre and 83 Square Metres, which belongs to him and is offering FSI<br \/>\ninstead of compensation to the petitioner in lieu thereof, which is<br \/>\nof no use to him as the petitioner is an agriculturist. It is further<br \/>\nsubmitted that the petitioner has made a representation dated<br \/>\n13.04.2010 to the Commissioner, Vadodara Municipal Corporation in<br \/>\nthis regard, to which no reply has been received. The learned counsel<br \/>\nfor the petitioner submits that the interest of justice would be met,<br \/>\nif the representation made by the petitioner is decided by the<br \/>\nCommissioner, Vadodara Municipal Corporation, and in that event, the<br \/>\npetitioner would not press the petition.\n<\/p>\n<p>\tIn<br \/>\nview of the submissions made by the learned counsel for the<br \/>\npetitioner and, in particular, in view of the prayer at paragraph<br \/>\n5(C) of the petition, as reproduced hereinabove, the following order<br \/>\nis passed:\n<\/p>\n<p>\tThe<br \/>\nCommissioner, Vadodara Municipal Corporation, shall consider the<br \/>\nrepresentation dated 13.04.2010 made by the petitioner and also give<br \/>\nhim an opportunity of hearing. After considering the same and after<br \/>\nhearing the petitioner, an appropriate order shall be passed, in<br \/>\naccordance with law on, or before, 15.05.2010. It is open to the<br \/>\npetitioner to make a request before the concerned authority to<br \/>\nmaintain status-quo during the pendency of the representation, which<br \/>\nshall be considered by the said authority, in accordance with law.<br \/>\nLiberty is reserved to the petitioner to approach this Court in case<br \/>\nof difficulty.
