ARCHANA\nPATEL for MR HARDIK C RAWAL for Appellant(s) :\n1, \nMR SANJAY M AMIN for Respondent(s) : 1 - 5,7 - 8. \nNone for\nRespondent(s) : 6, \n========================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\n \n\nDate\n: 23\/06\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>Challenge<br \/>\n\tin this Appeal filed under Section 110D of the Motor Vehicles Act,<br \/>\n\t1988 is to the correctness of the judgment and award dated 30.4.1991<br \/>\n\trendered in MACP No. 1297 of 1986 by the MACT(Auxi.), Kheda at<br \/>\n\tNadiad, by which the claim petition preferred by the Respondents<br \/>\n\toriginal claimants to recover the compensation of Rs.1,40,000\/- on<br \/>\n\taccount of untimely demise of Raijibhai Somabhai in a vehicular<br \/>\n\taccident has been partly allowed and thereby the claimants have been<br \/>\n\tawarded total compensation of Rs.1,35,720\/- together with interest @<br \/>\n\t12% pa from the date of filing of application for a period of three<br \/>\n\tmonths.  The award further stipulates that if the amount was paid<br \/>\n\tthereafter, the Appellant shall pay interest @15% pa from the date<br \/>\n\tof filing the application till realization.\n<\/p>\n<p>On<br \/>\n\t3.1.1986, Raijibhai Somabhai was going in a rickshaw along with<br \/>\n\tBhaijibhai Andersinh  and Dipabhai Samantbhai from village<br \/>\n\tSdharamkhoniya to Dakor.  Near Bhavans college, the rickshaw went<br \/>\n\tout of order and therefore the driver was repairing the rickshaw on<br \/>\n\tthe road and Raijibhai was standing near the rickshaw.  At that<br \/>\n\ttime, ST Bus bearing registration no. 7938 came there in an<br \/>\n\texcessive speed and hit Raijibhai and he was thrown on the road.<br \/>\n\tThe rear wheel of the bus passed over the waist of Raijibhai and he<br \/>\n\tdied instantaneously.  Therefore, according to the claimants, the<br \/>\n\taccident was a result of rash and negligent driving on part of the<br \/>\n\tdriver of the ST Corporation.\n<\/p>\n<p>Putting<br \/>\n\tforth the claim for compensation, it was averred that the deceased<br \/>\n\twas an agriculturist and he was earning Rs.10,000\/- per year.  On<br \/>\n\this death, there was nobody to take care of the agricultural land.<br \/>\n\tThe claimants were the dependants on the income of the deceased.<br \/>\n\tThe claimants have therefore filed claim petition claiming total<br \/>\n\tcompensation of Rs.1,40,000\/- together with interest, to which the<br \/>\n\treference is made in earlier paragraph of this judgment.\n<\/p>\n<p>The<br \/>\n\tclaim petition was resisted by the Appellant   GSRTC by filing<br \/>\n\twritten statement, wherein, the involvement of the ST bus in the<br \/>\n\taccident itself was denied and negligence on part of driver of the<br \/>\n\tST bus was also denied.  So far as the income of the deceased is<br \/>\n\tconcerned, it was also denied. It was therefore prayed to dismiss<br \/>\n\tthe claim petition.\n<\/p>\n<p>The<br \/>\n\tTribunal, on appreciation of evidence, came to the conclusion that<br \/>\n\tafter the accident, the driver ran away with the bus from the place<br \/>\n\tof accident.  On the basis of FIR, the registration number of ST bus<br \/>\n\twas disclosed and therefore, the Tribunal came to the conclusion<br \/>\n\tthat the Driver, after causing the accident ran away with the bus<br \/>\n\tfrom the place of accident and therefore he was rash and negligent<br \/>\n\tin driving the bus.\n<\/p>\n<p>So<br \/>\n\tfar as the quantification of compensation is concerned, the Tribunal<br \/>\n\thas assessed the income of the deceased at Rs.800\/-. Considering the<br \/>\n\tunit formula, the Tribunal has worked out the dependency benefit at<br \/>\n\tRs.644\/- per month and thereafter worked out dependency benefit at<br \/>\n\tfifteen multiplier and worked out total compensation of<br \/>\n\tRs.1,35,720\/-, which has given rise to the instant Appeal at the<br \/>\n\tinstance of the Appellant   GSRTC.\n<\/p>\n<p>This<br \/>\n\tCourt has considered the submissions advanced by learned advocate<br \/>\n\tMs. Archana Patel for the Appellant and Mr. Sanjay Amin, learned<br \/>\n\tadvocate for the claimants and also perused the impugned judgment<br \/>\n\tand award and considered the oral as well as documentary evidence,<br \/>\n\tcopies whereof have been supplied by them during the course of<br \/>\n\tsubmissions.\n<\/p>\n<p>So<br \/>\n\tfar as negligence attributed to the driver of the ST Corporation is<br \/>\n\tconcerned, on behalf of the complainant, claimant&#8217;s<br \/>\n\tbrother-in-law, who was present at the time of accident was examined<br \/>\n\tand he has also filed FIR and in the FIR, registration number of the<br \/>\n\tST bus was also given and on the basis of said FIR, ST bus was<br \/>\n\tlocated and from the register of the bus it was found out that the<br \/>\n\tsaid ST bus was plying on the same route at the same time.  However,<br \/>\n\tthe driver maintained that he did not cause this accident.  On<br \/>\n\treappraisal of the said evidence, according to this Court when the<br \/>\n\teyewitness has stated in the FIR that the bus had passed by  the<br \/>\n\troute and it was found that the same was plying on the same route at<br \/>\n\tthe relevant time, it has to be held that the bus owned by ST<br \/>\n\tCorporation, driven by its driver has caused the accident and since<br \/>\n\the ran away after causing the accident, he was not only negligent<br \/>\n\tbut he has failed in discharging his duty to inform the ST<br \/>\n\tCorporation about the accident which was caused by the bus driven by<br \/>\n\thim.  Therefore, the findings recorded by the Tribunal attributing<br \/>\n\tnegligence to the driver of the bus does not call for any<br \/>\n\tinterference.\n<\/p>\n<p>So<br \/>\n\tfar as quantification of compensation is concerned, Tribunal has<br \/>\n\tcome to the conclusion that the deceased was holding agricultural<br \/>\n\tland and he was working in a dairy.  Therefore the Tribunal has<br \/>\n\tassessed notional income of Rs.800\/- by way of loss of supervisory<br \/>\n\twork of agricultural holding and thereafter considering the unit<br \/>\n\tformula has worked out the dependency benefit after deducting<br \/>\n\texpenses for personal upkeep of the deceased and applied fifteen<br \/>\n\tmultiplier.\n<\/p>\n<p>On<br \/>\n\treappraisal of the evidence, according to this Court, the Tribunal<br \/>\n\thas committed no error in awarding total compensation of<br \/>\n\tRs.1,35,720\/-.
