MUNNI DEVI\n                             Versus\n                           THE STATE OF BIHAR\n              For petitioner no.1 : Mr.Sunil Kumar Singh\n              For the State       : Mr.Addl.P.P.\n                            -----------\n<\/pre>\n<p>5\/   03.11.2010                Heard       learned       counsel           for     the<\/p>\n<p>                  parties.\n<\/p>\n<p>                               Petitioner Gulten Mehta is one of six<\/p>\n<p>                  named        accused     of    a     case    which       has   been<\/p>\n<p>                  registered         for        offences       under        Sections<\/p>\n<p>                  307,302 and some other Sections of the Indian<\/p>\n<p>                  Penal Code.\n<\/p>\n<p>                               Allegation        is    that     the    petitioner<\/p>\n<p>                  no.1 and others formed an unlawful assembly<\/p>\n<p>                  and one of the members of unlawful assembly<\/p>\n<p>                  Manoj Mehtar assaulted upon the head of the<\/p>\n<p>                  informant&#8217;s          father.         Other     accused         also<\/p>\n<p>                  assaulted by means of lathi and danda.<\/p>\n<p>                               Submission is that no overt act is<\/p>\n<p>                  attributed         against the petitioner no.1 and<\/p>\n<p>                  he     has    no   criminal         antecedent.
