JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\nDate\n: 13\/10\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\napplication has been filed under Order 5, Rule 20 of the Code of<br \/>\nCivil Procedure, 1908, for substituted service of respondent No.1\/B &#8211;<br \/>\nSubhashbhai T.Sharma.\n<\/p>\n<p>\tMr.V.C.Thomas,<br \/>\nlearned advocate for Mr.Vibhuti Nanavati, learned counsel for the<br \/>\napplicant, submits that the respondents are members of the same<br \/>\nfamily. During the course of service of Notice, it was discovered<br \/>\nthat a commercial complex in the name and style of Narayan Complex<br \/>\nhas been erected at the original address mentioned in the cause-title<br \/>\nand in spite of best efforts, the whereabouts of respondent No.1\/B<br \/>\ncould not be ascertained. It is further submitted that it appears<br \/>\nthat the said respondent may be trying to evade service of Notice and<br \/>\nas the whereabouts and current address of the said respondent is not<br \/>\nforthcoming from the other respondents as well, the prayers made in<br \/>\nthe application may be granted.\n<\/p>\n<p>\tMr.D.P.Kinariwala,<br \/>\nlearned advocate for respondent No.1\/A has submitted that he is not<br \/>\nin a position to contact his client or obtain necessary instructions<br \/>\nregarding the address of the unserved respondent, therefore, the<br \/>\nCourt may pass appropriate orders.\n<\/p>\n<p>\tIn<br \/>\nview of the submission that the address of respondent No.1\/B is not<br \/>\nforthcoming from the other respondents who are members of the same<br \/>\nfamily and a commercial complex has been constructed at the original<br \/>\naddress mentioned in the cause-title and as the whereabouts of the<br \/>\nsaid respondent could not be ascertained in spite of best efforts,<br \/>\nthe prayers made in the application deserve to be granted.\n<\/p>\n<p>\tAccordingly,<br \/>\nthe application is allowed.
