PATTANAIK (J)\n\nCITATION:\n JT 1996 (7)\t 5\t  1996 SCALE  (5)510\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t THE 15TH DAY OF JULY, 1996<br \/>\nPresent.\n<\/p>\n<p>\t  Hon&#8217;ble Mr.Justice K.Ramaswamy<br \/>\n\t  Hon&#8217;ble Mr.Justice G.B.Pattanaik<br \/>\nK.B.Rohtagi and Ms. Aprana Rohtagi, Advs. for the appellent<br \/>\nR.Bana, Adv. for the Respondents<br \/>\n\t\t\t O R D E R<br \/>\nThe following Order of the Court was delivered:<br \/>\nKashmir Chand<br \/>\nV.\n<\/p>\n<p>Financial Commissioner, Haryana<br \/>\n&amp; Ors.\n<\/p>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     We have heard learned counsel on both sides.<br \/>\n     Admittedly, the  plot was\tsold in an open auction held<br \/>\nin July,  1971 for  a sum  of Rs.46,000\/-. The appellant has<br \/>\npaid only  11,500\/-. He\t was  due  of  the  balance  sum  of<br \/>\nRs.34,500\/- In\tterms of  the auction,\the had\tnot complied<br \/>\nwith the  payment for  well over  21 years. Consequently, he<br \/>\nwas demanded  payment of  a sum\t of Rs.3,78,000\/-  which  he<br \/>\ndefaulted to  pay. When allotment was sought to be cancelled<br \/>\nhe calling that action in question, filed a writ petition to<br \/>\nthe High Court. Pending writ petition, the High Court passed<br \/>\nan  order   in\ta  civil  miscellaneous\t case.\tTherein\t the<br \/>\nappellant had  asserted that  he had  deposited the  sum  of<br \/>\nRs.34,500\/- on\tSeptember 21,  1992. The Court found that in<br \/>\ncase the  said\tamount\tof  Rs.34,500\/-\t was  deposited,  as<br \/>\ncontended  by\tthe  appellant,\t  the  balance\t amount\t  of<br \/>\nRs.3,43,500 was\t directed to  be deposited  but he  had\t not<br \/>\ndone. Consequently,  the writ  petition was dismissed and an<br \/>\nappeal in  the impugned\t order in  MPA No.355\/93  dated 19th<br \/>\nAugust, 1993,  the order  of the  learned single  Judge\t was<br \/>\nconfirmed.\n<\/p>\n<p>     Though time  was taken for filing the counter, the same<br \/>\nwas not\t filed by the respondents. It is stated by Shri K.B.<br \/>\nRohtagi, learned  counsel for the appellant, that his client<br \/>\nhad already  deposited two  instalments of  the amount\twith<br \/>\ninterest @  12% and  one instalment  is due.  We prima facie<br \/>\naccept the  statement of  the counsel to be correct. In case<br \/>\nthose payments\thave already  been made,  the  appellant  is<br \/>\ngiven liberty to pay the balance amount within a period of 4<br \/>\nmonths from  today. In\tcase he has not already deposited or<br \/>\nif he  commits default in payment of the amount as directed,<br \/>\nthis order  would stand\t vacated and  the order\t of the High<br \/>\nCourt would stand restored.\n<\/p>\n<p>     The appeal is accordingly disposed of.
