                      appears on behalf of Respondent Nos. 1 to 3\/claimants. None<\/p>\n
                      appeared on behalf of Respondent Nos. 4 & 5.\n<\/p>\n
                                 The present appeal under Section 173 of the Motor<\/p>\n
                      Vehicles Act, 1988 (hereinafter referred to as the M.V. Act) has<\/p>\n
                      been preferred against judgment dated 5th April, 2010 and award<\/p>\n
                      dated 29.04.2010 in Claim Case No. 190 of 2009 passed by 1st<\/p>\n
                      Additional District Judge-cum-Motor Vehicles Accident Claims<\/p>\n
                      Tribunal, Bhagalpur (hereinafter referred to as the “Claims<\/p>\n
                      Tribunal”). The appeal has been preferred by the Oriental Insurance<\/p>\n
                      Co. Ltd (insurer) only to the extent of challenging the compensation
\n                      2<\/span><\/p>\n
amount.\n<\/p>\n
           Learned counsel for the appellant has not disputed the<\/p>\n
impugned judgment on its merit but has argued that since there were<\/p>\n
no documentary evidence on record in support of the income of the<\/p>\n
deceased the learned Claims Tribunal       was required to adopt<\/p>\n
notional income in view of Schedule-II of the Motor Vehicles Act.<\/p>\n
           Short fact of the case is that on 06.11.2009 at 6.30 a.m.<\/p>\n
while wife of Respondent No. 1 and mother of Respondent Nos. 2<\/p>\n
& 3 was going to open her tea stall she was dashed by a Bus bearing<\/p>\n
registration no. BR10H-7726. The accident had occurred due to<\/p>\n
negligent and rash driving of the vehicle by the driver. In the said<\/p>\n
accident the wife of Respondent No. 1 namely Rukmani Devi died.<\/p>\n
Relating to said occurrence F.I.R. vide Mojahidpur P.S. case No.<\/p>\n
112 of 2009 was registered against the driver of the vehicle and on<\/p>\n
the dead body of the deceased autopsy was conducted.<\/p>\n
Subsequently, claim petition was filed under the provisions of the<\/p>\n
M.V. Act by the claimants i.e. Respondent Nos. 2 & 3. In support of<\/p>\n
claim case four (04) witnesses were examined. Out of four (04)<\/p>\n
witnesses, C.W. 1 is Respondent No. 3 , C.W. 2 is Respondent No.<\/p>\n
1, C.W. 3 is Respondent No. 2 and one another witness namely<\/p>\n
Rajendra Prasad Sah was examined as an independent witness.<\/p>\n
During the trial it was admitted that offending vehicle was insured<\/p>\n
by the appellant and also driver of the vehicle was having valid<\/p>\n
driving licence at the time of accident. The claimants had pleaded<\/p>\n
that deceased was having income in between Rs. 150\/- to Rs. 200\/-
\n                      3<\/span><\/p>\n
per day. However, learned Claims Tribunal taking into account the<\/p>\n
income of the deceased as Rs. 125\/- per day had finally directed the<\/p>\n
appellant to pay total compensation amount of Rs. 3,90,000\/- and<\/p>\n
also Rs. 2,000\/- towards funeral expenses, Rs. 5,000\/- towards loss<\/p>\n
of consortium and Rs. 2,500\/- towards loss of estate. Since Rs.<\/p>\n
50,000\/- was already paid under Section 140 of the M.V. Act as<\/p>\n
interim compensation it was directed to deduct the said amount and<\/p>\n
remaining amount was directed to be paid along with interest at the<\/p>\n
rate of 6% per annum till the date of payment.\n<\/p>\n
           The insurer i.e. the appellant aggrieved with the<\/p>\n
compensation amount has preferred the present appeal oblivious of<\/p>\n
the fact that before the court below cogent materials were brought<\/p>\n
on record in support of the income of the deceased.<\/p>\n
           Sri Barun Kumar Choudhary, learned counsel for the<\/p>\n
appellant has emphatically argued that in absence of documentary<\/p>\n
evidence in support of the proof of income of the deceased the<\/p>\n
learned Claims Tribunal was required to take into account notional<\/p>\n
income as prescribed in Schedule-II of the M.V. Act. It was<\/p>\n
submitted that while granting compensation the court is required to<\/p>\n
see that compensation in an accident may not be treated as windfall<\/p>\n
in favour of the claimants. In support of his argument he has relied<\/p>\n
on (2009) 13 SCC 422 ( Reshma Kumari & Ors. Vs Madan Mohan<\/p>\n
& Anr.). On question put by the court as to whether there is any<\/p>\n
statutory provision which prescribes that for establishing income<\/p>\n
documentary evidence is must to be produced by the claimant
\n                      4<\/span><\/p>\n
learned counsel for the appellant answered in negative. However, he<\/p>\n
relying on the judgment in Reshma Kumari Case (Supra) has only<\/p>\n
argued that keeping in view the fact and circumstances of the<\/p>\n
present case that too since the deceased was a house wife such high<\/p>\n
compensation amount should not have been directed to be paid and<\/p>\n
as such it was submitted that since death had occurred the Tribunal<\/p>\n
was required to give minimum compensation amount accepting the<\/p>\n
notional income as prescribed in the Act. Accordingly it has been<\/p>\n
prayed to modify the impugned judgment and award.<\/p>\n
            Sri Vivekanand Vivek, learned counsel for Respondent<\/p>\n
Nos. 1 to 3 \/claimants submits that the compensation amount is<\/p>\n
reasonable one which requires no interference. He has argued that<\/p>\n
there is consistent evidence on record that the deceased was having<\/p>\n
Rs. 150\/- to Rs. 200\/- income per day and as such the learned<\/p>\n
Claims Tribunal has rightly awarded compensation amount. He has<\/p>\n
further argued that there are number of decisions to show that if<\/p>\n
there is oral evidence on the point of income the claim cannot be<\/p>\n
denied only on the plea that there is no documentary evidence.<\/p>\n
            Besides hearing learned counsel for the parties I have<\/p>\n
also perused the materials available on record.<\/p>\n
            In this case four (04) witnesses were examined in<\/p>\n
support of the claim case and all the four (04) witnesses have<\/p>\n
consistently stated that deceased was having income of Rs. 150\/- to<\/p>\n
Rs. 200\/- per day. It is true that three witnesses out of four were<\/p>\n
claimants in the case but C.W. 4 (Rajendra Prasad Sah) who was
\n                      5<\/span><\/p>\n
completely an independent witness has categorically supported the<\/p>\n
claimants’ case. In his evidence he has stated that while he along<\/p>\n
with one another was moving he witnessed the accident in which<\/p>\n
Rukmani Devi wife of Respondent No. 1 and mother of Respondent<\/p>\n
Nos. 2 & 3 succumbed to the injuries. The witness C.W. 4 has also<\/p>\n
stated that the deceased was going to open her tea stall. Consistently<\/p>\n
it has been said by all the witnesses that deceased was running a tea<\/p>\n
stall. The husband of the deceased i.e. C.W. 2 (Respondent No. 1)<\/p>\n
has further stated that since last five years he was ailing and he was<\/p>\n
completely dependent on his wife who was running tea stall and was<\/p>\n
earning Rs. 150\/- to Rs. 200\/- daily.\n<\/p>\n
            In view of the facts and circumstances particularly the<\/p>\n
evidence brought on record the court is of the opinion that the<\/p>\n
claimants have established that the deceased was having earning as<\/p>\n
stated in the claim petition. For the purposes of establishing income<\/p>\n
of deceased or a victim there is no mandatory provision to bring on<\/p>\n
record documentary evidence. If there is reliable oral evidence the<\/p>\n
income can be accepted. So far application of notional income is<\/p>\n
concerned, Schedule-II makes it clear that notional income shall be<\/p>\n
taken into account in cases of those victims or deceased who had no<\/p>\n
income prior to the accident. In the present case there is consistent<\/p>\n
evidence that deceased was running a tea stall and earning Rs. 150\/-<\/p>\n
to Rs. 200\/- per day. However, the Claims Tribunal has accepted<\/p>\n
only Rs. 125\/- per day, and thereafter, adopting multiplier of 13 has<\/p>\n
awarded compensation.\n<\/p>\n
                               6<\/span><\/p>\n
                     In view of the facts and circumstances as well as<\/p>\n
         evidence on record, the court is of the opinion that the impugned<\/p>\n
         judgment and award require no interference, and as such, the appeal<\/p>\n
         stands dismissed.\n<\/p>\n
                     The compensation amount with interest as directed by<\/p>\n
         the Claims Tribunal must be paid to the claimants within two<\/p>\n
         months from the date of receipt\/production of a copy of this order.<\/p>\n
                     Since the appeal has been dismissed the statutory<\/p>\n
         amount which was deposited at the time of filing of the appeal may<\/p>\n
         be remitted back to the court below.\n<\/p>\n<\/p>\n
