Senior Civil Judge, Ahmedabad (Rural) at<br \/>\nNavrangpura in Land Acquisition Cases No. 369\/2003 to 372\/2003 and<br \/>\n374\/2003 to 386\/2003 dated 09.05.2006 whereby, the Reference Court<br \/>\nawarded additional compensation @ Rs.67.20 per sq. metre as against<br \/>\nthe claim of Rs.100\/- per sq. metre by the claimants.\n<\/p>\n<p>2.0\t\tThe<br \/>\nfacts in brief leading rise to the filing of the present appeals are<br \/>\nas under;\n<\/p>\n<p>2.1\t\tThe<br \/>\nappellant ?  State proposed to acquire the agricultural lands of<br \/>\nVillage Kadadara, Taluka Dehgam, District Ahmedabad for the purpose<br \/>\nof construction of a Canal under the Narmada Project. A Notification<br \/>\nunder Section 4(1) of the Act was issued, which was published in the<br \/>\nOfficial Gazette on 20.01.2000. Thereafter, the State Government made<br \/>\na declaration under Section 6 of the Act, which was published on<br \/>\n06.12.2000. The interested persons were served with Notices for<br \/>\ndetermination of compensation payable to them. The claimants appeared<br \/>\nbefore the Special Land Acquisition Officer and claimed compensation<br \/>\nat the rate of Rs.100\/- per sq. metre. However, the Special Land<br \/>\nAcquisition Officer offered compensation to the claimants at the rate<br \/>\nof Rs.6\/- per sq. metre.\n<\/p>\n<p>2.2\t\tThe<br \/>\nclaimants, seeking higher compensation, raised a dispute, which,<br \/>\nultimately, came to be referred to the competent Court by way of<br \/>\nReferences. On appreciation of the evidence adduced by the parties,<br \/>\nthe Reference Court was of the opinion that the previous award of the<br \/>\nReference Court relating to the lands of the very same Village was a<br \/>\nrelevant piece of evidence and furnished good guidance for the<br \/>\npurpose of determining the market value of the lands acquired in the<br \/>\ninstant case. The learned Judge noticed that notification under<br \/>\nSection 4(1) of the Act was published in the Official Gazette on<br \/>\n11.01.1990 for the lands acquired earlier; whereas, in the instant<br \/>\ncase, the notification under the said Section was issued on<br \/>\n20.01.2000.  He, thereafter, calculated the reasonable rise in the<br \/>\nprice of the lands at the rate of 10% per annum. For earlier<br \/>\nacquisition of the lands, award at the rate of Rs.37.60 per sq. metre<br \/>\nwas passed. Considering that aspect, the trial Judge derived a figure<br \/>\nof Rs.73.20 per sq. metre and ordered to pay the additional<br \/>\ncompensation at the rate of Rs.67.20 per sq. metre over and above the<br \/>\ncompensation awarded by the Land Acquisition Officer at the rate of<br \/>\nRs.6\/- per sq. metre.\n<\/p>\n<p>3.0\t\tLearned<br \/>\nAGP for the appellant ?  State submitted that the claimants had not<br \/>\nproduced sale bills or purchase bills to show the expenditure<br \/>\nincurred by the claimants for fertilizers, seeds, medicines, etc. It<br \/>\nis further contended that even apart from the above bills, no<br \/>\ndocument is produced to prove that the lands in dispute were of equal<br \/>\nfertility, potentiality and having equal facilities as compared to<br \/>\nthe lands for which L.A.R. No.705 of 1991 was passed. It is also<br \/>\ncontended that the learned trial Judge has not discussed the aspect<br \/>\nas to how the said award was comparable.  In response, Mr. K. M.<br \/>\nSheth has submitted that as the lands of earlier Reference were of<br \/>\nthe same Village, it could safely be presumed that the award was<br \/>\ncomparable.\n<\/p>\n<p>4.0\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. Having gone through the entire record, I am of the opinion<br \/>\nthat the compensation awarded by the learned Civil Judge is<br \/>\nabsolutely just and proper. The learned Civil Judge has rightly<br \/>\nconsidered the award passed in L.A.R. Case No. 705 of 1991 as the<br \/>\nsame was comparable in facts and circumstances of the present case.<br \/>\nThe said Reference was for the lands of the very same village having<br \/>\nsimilar fertility, potentiality and facilities. It may also be noted<br \/>\nthat the said award is accepted by the acquiring authorities.\n<\/p>\n<p>5.0\t\tIt<br \/>\nmay also be noted that the acquiring authority had chosen not to<br \/>\nexamine any witness on its behalf. Not only that but it has also not<br \/>\nled any documentary evidence to show that the market price of the<br \/>\nacquired lands were below Rs.73.20 per sq. metre. It is true that the<br \/>\nclaimants could not make good their assertion that they were entitled<br \/>\nto get the compensation at the rate of Rs.100\/- per sq. metre.<br \/>\nHowever, the record indicates that, by producing the comparable<br \/>\naward, they could prove that they were entitled to get the<br \/>\ncompensation at the rate of Rs.73.20 per sq. metre. In view of the<br \/>\ntime gap between two Notifications published under Section 4(1) of<br \/>\nthe Act, the claimants would be entitled to benefit of reasonable<br \/>\nrise in prices of lands at the rate of 10% per annum. Hence, the<br \/>\nReference Court has rightly awarded the additional compensation at<br \/>\nthe rate of Rs.67.20 per sq. metre. I do not find much substance in<br \/>\nthe contentions of the learned Assistant Government Pleader.\n<\/p>\n<p>6.0\t\tBy<br \/>\nno stretch of imagination, Rs.73.20 per sq. metre can be termed as<br \/>\nexcessive or exorbitant, when the State has compulsorily acquired the<br \/>\nsaid lands against the wish of the claimants and when they have lost<br \/>\ntheir livelihood. The award passed by the Special Land Acquisition<br \/>\nOfficer granting the compensation at the rate of Rs.6\/- per sq. metre<br \/>\nwas arbitrary and atrocious and hence, the Trial Court has rightly<br \/>\nenhanced it to the tune of Rs.73.20 per sq. metre. It is well settled<br \/>\nprinciple of law that the previous award passed by the Reference<br \/>\nCourt relating to the lands of same village, if has attained<br \/>\nfinality, is a very good piece of evidence for the purpose of<br \/>\ndetermining  market value of similar lands acquired from the same<br \/>\nvillage subsequently.\n<\/p>\n<p>7.0\t\tIn<br \/>\nthe facts and circumstances of the case, this Court is of the opinion<br \/>\nthat the Reference Court did not commit any error in enhancing the<br \/>\ncompensation. The Civil Court has passed a well reasoned judgment.<br \/>\nThis Court, therefore, finds no reason to interfere with the award<br \/>\npassed by the Reference Court. Hence, the appeals are dismissed.<br \/>\nThere shall be no order as to costs. The Registry is directed to draw<br \/>\nthe decree in terms of this judgment immediately. The amount<br \/>\ndeposited by the appellants at the time of admission of the appeals<br \/>\nmay be disbursed to the respective claimants after verification of<br \/>\ntheir identity, if not disbursed so far.\n<\/p>\n<p>8.0\t\tRecord<br \/>\nand proceedings, if is lying with the Registry of this Court, be sent<br \/>\nback to the trial Court concerned.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
