It is the case of the petitioner that though the<br \/>\npetitioner fulfills the requirement for  Mining lease to be allotted,<br \/>\nthe respondent authorities have not paid any heed inspite of opinions<br \/>\nfrom experts in his favour.  Further the respondent has been inviting<br \/>\nnew applications without deciding the petitioner&#8217;s application which<br \/>\nis pending since long.  Hence this petition is preferred.\n<\/p>\n<p>3.\tMr.\n<\/p>\n<p>Mansuri, learned advocate appearing for the petitioner has submitted<br \/>\nthat the respondent no. 1 has passed notification on 17.12.2009<br \/>\ninviting applications for mining lease for survey no. 182\/2 of sim of<br \/>\nGariya, Lunavada.  He has submitted that as per section 11(2) of the<br \/>\nAct the applicant whose application is received earlier shall have<br \/>\nthe preferential right to be considered for grant of mining lease<br \/>\nover the applicant whose application is received later.\n<\/p>\n<p>4.\tThis<br \/>\ncourt has heard learned advocates for the parties and perused the<br \/>\npapers on record.  As a result of the said exercise, this court is of<br \/>\nthe view that in the interest of justice, the following directions<br \/>\nare required to be issued:\n<\/p>\n<p>The<br \/>\n\tapplication of the petitioner pursuant to the notification dated<br \/>\n\t17.12.2009 shall be considered within a period of three months from<br \/>\n\tthe last date of receipt of applications.\n<\/p>\n<p>It<br \/>\n\tis made clear that this court has not entered into the merits of the<br \/>\n\tmatter.\n<\/p>\n<p>The<br \/>\n\trespondent authority shall decide the application of the petitioner<br \/>\n\tin accordance with law and relevant provisions of the Act.\n<\/p>\n<p>5.\tWith<br \/>\nthe above directions and observations, this petition is disposed of.<br \/>\nDirect service is permitted.
