Heard the counsel for the parties.\n<\/p>\n<p>The prayer of the petitioner in this writ application is for direction to the respondents to give him promotion to the post of Assistant Traffic Inspector in Scheduled Caste quota w.e.f. 1992 since juniors to him have already been promoted to the said post.\n<\/p>\n<p>2. The petitioner was given one promotion from the post of Conductor to Time Keeper in the year 1992 as it appears from Annexure-1. It is submitted by the petitioner that his case for promotion to the post of Assistant Traffic Inspector has not been considered by the respondents on the ground that his service records were not available with them. The petitioner has also made a representation before the Administrator, Bihar State Road Transport Corporation, Patna, which was duly forwarded by the Divisional Manager, Ranchi, but still his representation for promoting him to the post of Assistant Traffic Inspector has not been considered and no order in that regard has been passed.\n<\/p>\n<p>3. In the counter affidavit, filed by the respondents, it is stated that the petitioner&#8217;s case for promotion to the post of Assistant Traffic Inspector could not be considered because of the fact that at that time a departmental proceeding was pending against him and service records of the petitioner was also not available. It is also stated therein that the representation of the petitioner is pending and the same shall be considered in accordance with law.\n<\/p>\n<p>4. Considering the above fact, this writ application is being disposed of by directing the respondents to consider the representation of the petitioner for promotion to the post of Assistant Traffic Inspector in its right perspective and pass an appropriate order in accordance with law within a period of six weeks from the date of receipt\/production of a copy of this order.\n<\/p>\n<p>5.
