N.R.Pura con\ufb01rmed in Cximinal Appeal No.1’72\/200$’  5.1:’; <\/p>\n
of Fast Track Court-I. Chikxnagalur.\n<\/p>\n
2. Respondent is the coxnplainant,  It is;–“a11\u00a2’g\u00e9d  <\/p>\n
petitioner herein had borrowed a of Rs.4’6,(X3Gj1-  to<\/p>\n
repay the said amount    ?.4″%> iiA3;terest per
\nannum. The complainant    amount. In
\nresponse to the s\u00a7mie;, ‘_’the  cheques dated
\n19.3.2003 for  5i\u00a2;.4.’2oo3 for 9315,0001-.
\nwhen the   were returned to the
\nIespondennwitig  .”:insu\ufb01eie11t fund”. In this<\/p>\n
regard, a lef\u00a7al_4_VVVnotViee 8.7 .2003 was issued by the<\/p>\n
jsespondentv.  On  ,of the same, the petitioner herein<\/p>\n

4. The Mal court on appreciation of the evidence convicted
\nthe accused for an offence punishable under Section.,”1{38 of<\/p>\n
Negotiable Instruments Act. The accused \ufb01led an <\/p>\n
the lower appellate court. The appellate  ”  <\/p>\n
consideration and re-appxreciatzion of ithel evidence;  the ‘<\/p>\n
judgment of the trial court.\n<\/p>\n
5. Learned Counsel for thelvlvupetitionetll  that. the<\/p>\n
legal notice is dated  ts”‘–no acknotvledgement
\nproduced for having served\ufb02   However, reply is
\ngiven to the   notice on  V The complaint is
\n\ufb01led on   is no date of receipt of
\nthe iegal     taking into consideration
\nthe date on  complaint is within 15 days<\/p>\n
from the date lofhzecelipt  legal notice. The complaint is not<\/p>\n

the  that. the petitioner herein had borrowed<\/p>\n
 bepayahle after six months, though the cheques<\/p>\n

\n He also contended that. the cheques were collected
\n itowaxds the chit fund business and after payment of chit fund,<\/p>\n
3  the cheques are not returned. and it is clear from the evidence of<\/p>\n
DWs- 1 to 3. The respondent was in the habit of collecting blank<\/p>\n

\nnotice by registered post is also produced. which is dated<\/p>\n
8.7.2003. If the date of acknowledgement is taken as <\/p>\n
the complaint is \ufb01led after expiry of 15 days   .<\/p>\n
submitted that, in the order sheet of themtrial 0′ ” ‘V <\/p>\n
filed by the respondent is also recorded.<\/p>\n
‘7. As regards to the demandiotiiamount inonths, 0′ 0<\/p>\n
he submitted that, though the cheqnes”Lsre–~datedA’  and
\n10.4.2003, they were itinfeentonths i.e., after
\nexpiry of six months._:”H__e   at no point of
\ntime, the  cheques are lying
\nwith the respondent;    thought, when the
\nlegal notice by way of reply such a contention
\nis raised. He\ufb01nther’ ttiat. according to the reply. the<\/p>\n
chit \ufb01lndgebusixxess’-got’ ovei?  February 2003 and the cheques<\/p>\n

\n if the._c\u00a71it fund business got over in 2001, the petitioner
\n Vnotihave kept quiet \ufb01ll July 2003 and there is no evidence
\n  that. at any point of time. such a demand is made except
\n A\u00e9\u00e9sefti\ufb02g in the oral evidence. No material is produced by the<\/p>\n
 petitioner. He also submitted that, to prove that there was a chit<\/p>\n

fund business, no–evidence is produced except oral evidence of
\nDws-2 and 3. Legally chit fund business cannot be earned.<\/p>\n
without valid licence under the provisions of Chit <\/p>\n
submitted that, such a contention cannot be raised__iji1iee$- _<\/p>\n
is a speci\ufb01c material.\n<\/p>\n
8. Insofar as contention as Iegogd  <\/p>\n

days. I do -jnotd  is any justi\ufb01eation in the<\/p>\n
contention Ieisedtby  Counsel for the petitioner. Even<\/p>\n

   for the purpose of marking the same. again<\/p>\n

\n‘iea\u00e9pondent had carried on the chit fund business for an amount<\/p>\n
 of Rs.’.23,{)O0\/ –, but looking at the reply given by the petitioner as<\/p>\n

that is so, haw many instalments of chit fund was paid, how<\/p>\n
many cheques were issued as security and why demand for the
\nreturn of cheques was not made and same is not explained either<\/p>\n
in the reply notice or in the evidence.\n<\/p>\n

 submissions of both sides, though the matter was disposed of on<\/p>\n
