{"id":204065,"date":"2010-06-30T00:00:00","date_gmt":"2010-06-29T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/maharaj-singh-vs-lalit-kumar-katare-on-30-june-2010"},"modified":"2019-02-23T05:56:14","modified_gmt":"2019-02-23T00:26:14","slug":"maharaj-singh-vs-lalit-kumar-katare-on-30-june-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/maharaj-singh-vs-lalit-kumar-katare-on-30-june-2010","title":{"rendered":"Maharaj Singh vs Lalit Kumar Katare on 30 June, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Madhya Pradesh High Court<\/div>\n<div class=\"doc_title\">Maharaj Singh vs Lalit Kumar Katare on 30 June, 2010<\/div>\n<\/p>\n<pre><\/pre>\n<p>                      M.A. No. 1655\/10<\/p>\n<p>     30.06.2010<\/p>\n<p>     Appellant by Shri U.K.Shukla, Advocate.<br \/>\n     Default is ignored and the appeal is heard on<br \/>\nadmission.<\/p>\n<p>     This is an appeal by the owner of the Jeep<br \/>\nchallenging the award dated 23.9.2009 passed by the<br \/>\nMotor Accident Claims Tribunal in Claim Case No.<br \/>\n34\/09 wherein the Insurance Company has been<br \/>\nexempted from paying compensation and the liability<br \/>\nhas been fixed of the present appellant who was the<br \/>\nNon Applicant No.2.\n<\/p>\n<p>     The tribunal came to the conclusion that the<br \/>\nsaid vehicle was plied without there being any permit<br \/>\nand since it was a case of breach of policy, the<br \/>\nInsurance Company has been exempted. The tribunal<br \/>\nhas awarded a sum of Rs.18,330\/-. The basis for the<br \/>\naforesaid award is that the claimant after the<br \/>\naccident was admitted to the Hospital for a period<br \/>\nfrom 17.4.08 to 19.4.08. He has also received<br \/>\ntreatment from Doctor Amol Bhansali and Doctor<br \/>\nSharad Rathi up to 24.6.08 and on the basis of the<br \/>\nsame, the tribunal in para 18 of the award held that<br \/>\nfrom the documents, Ex. P\/11 to P\/17 it is clear that<br \/>\ntribunal has awarded a sum of Rs.2,330\/- towards the<br \/>\nbills relating to the treatment for purchase of<br \/>\nmedicines. The expenses for receiving treatment and<br \/>\nother heads is also awarded and thus the total<br \/>\n amount of Rs.18,330\/-. The tribunal has recorded a<br \/>\nfinding that the injuries were simple in nature but<br \/>\nsince there had been injuries, therefore, the amount<br \/>\nas such has been awarded.\n<\/p>\n<p>      In view of the aforesaid, I do not find any<br \/>\njustification to admit the present appeal. Accordingly,<br \/>\nappeal stands dismissed.\n<\/p>\n<p>                                          (R.K.
