It is<br \/>\nalso observed that  the applicant shall be entitled for the set-of of<br \/>\nthe amount already deposited pending the suit and the remaining<br \/>\namount shall be required to be deposited.\n<\/p>\n<p>4.\tWe<br \/>\nhave heard learned counsel for both the sides on the aspect of<br \/>\nwithdrawal of the amount.\n<\/p>\n<p>5.\tAs<br \/>\nsuch it is money decree and upon furnishing  the security, one may be<br \/>\nentitled for withdrawal of the amount. However, the apprehension<br \/>\nvoiced by the applicant &#8211; appellant is that if the company is<br \/>\nnot financially sound, it will be difficult for the applicant-<br \/>\nappellant to recover the amount and it was also submitted that there<br \/>\nare various contentions including that the court had no jurisdiction<br \/>\nor that there was no liability on the part of the applicant &#8211;<br \/>\nappellant &#8211; original defendant.\n<\/p>\n<p>6.\tHence,<br \/>\nconsidering the facts and circumstances, we find that it would be<br \/>\njust and proper if bank guarantee is furnished by the respondent &#8211;<br \/>\noriginal plaintiff against the withdrawal of the amount. When the<br \/>\nbank guarantee is to be furnished, the applicant &#8211; appellant<br \/>\nwill be in a position to recover the amount back in the event it<br \/>\nsucceeds in the present appeal.\n<\/p>\n<p>7.\tHence,<br \/>\nit is observed and directed that the respondent &#8211; original<br \/>\nplaintiff shall be at liberty to withdraw the amount which may be<br \/>\ndeposited by the applicant &#8211; appellant &#8211; original<br \/>\ndefendant, upon furnishing bank guarantee  which will be valid for a<br \/>\nperiod of three years and the bank guarantee shall be renewed from<br \/>\ntime to time until the first appeal is finally heard and disposed.\n<\/p>\n<p>8.\tThe<br \/>\napplication is allowed to the aforesaid extent. Rule made absolute<br \/>\naccordingly.\n<\/p>\n<p>9.\tConsidering<br \/>\nthe facts and circumstances, the First Appeal shall be listed for<br \/>\nfinal hearing on 14.7.2011.\n<\/p>\n<p>(JAYANT<br \/>\nPATEL, J.)<\/p>\n<p>(MS.\n<\/p>\n<p>B.M.
