Whether the judgment should be reported in the Digest ?\n<\/p>\n<p>                                ***<\/p>\n<p>AJAY TEWARI, J (Oral)<\/p>\n<p>             This writ petition has been filed challenging the action of the<\/p>\n<p>respondents whereby the petitioner has been punished on account of the fact<\/p>\n<p>that a person in his custody escaped. Originally, the penalty imposed upon<\/p>\n<p>the petitioner was stoppage of five increments with permanent effect which<\/p>\n<p>has in appeal\/revision been reduced to stoppage of two increments with<\/p>\n<p>permanent effect.\n<\/p>\n<p>             Counsel for the petitioner has raised        two fold arguments.<\/p>\n<p>Firstly, the petitioner was acquitted in the criminal case and secondly the<\/p>\n<p>revisional order does not contain any reasons.\n<\/p>\n<p> C.W.P No. 2372 of 2009                                     ::2::\n<\/p>\n<p>            As regards the first contention, there is a catena of judgments<\/p>\n<p>which lay down that mere acquittal in a criminal case could not be a ground<\/p>\n<p>for holding a delinquent employee not guilty in departmental proceedings.<\/p>\n<p>As regards the second contention, counsel for the petitioner has relied upon<\/p>\n<p>Raj Kishore Jha vs State of Bihar and others, 2003(11) SCC 519, wherein<\/p>\n<p>the Hon&#8217;ble Supreme Court has held as follows :-<\/p>\n<blockquote><p>                  &#8220;&#8230;. Reason is the heartbeat of every conclusion. Without<\/p>\n<p>                  the same it becomes lifeless&#8230;.&#8221;<\/p>\n<p>            It may be noticed that the Hon&#8217;ble Supreme Court in <a href=\"\/doc\/1015660\/\">Narinder<\/p>\n<p>Mohan Arya v. United India Insurance Co. Ltd and others<\/a>, (2006) 4<\/p>\n<p>SCC 713, held in para 33 as follows:-\n<\/p>\n<blockquote><p>                          &#8220;An appellate order if it is in agreement with that of<br \/>\n                  the disciplinary authority may not be a speaking order<br \/>\n                  but the authority passing the same must show that there<br \/>\n                  had been proper application of mind on his part as<br \/>\n                  regards the compliance with the requirements of law<br \/>\n                  while exercising his jurisdiction under Rule 37 of the<br \/>\n                  Rules.&#8221;<\/p><\/blockquote>\n<p>            Further, in <a href=\"\/doc\/751822\/\">Tara Chand Khatri v. Municipal Corporation of<\/p>\n<p>Delhi and others<\/a> reported as (1977) 1 SCC 472 the Hon&#8217;ble Supreme<\/p>\n<p>Court held as follows:-\n<\/p>\n<blockquote><p>                  &#8220;<a href=\"\/doc\/656488\/\">In Madhya Pradesh Industries Ltd. v. Union of India,<\/a><br \/>\n                  this Court repelled the contention of counsel for the<br \/>\n                  appellant that every order appealable under Article 136<br \/>\n                  of the Constitution must be a speaking order and the<br \/>\n                  omission to give reasons for the decision is of itself a<br \/>\n                  sufficient ground for quashing it and held that an order of<br \/>\n                  an administrative tribunal rejecting a revision application<br \/>\n                  cannot be pronounced to be invalid on the sole ground<br \/>\n                  that it does not give reasons for rejection. While<br \/>\n C.W.P No. 2372 of 2009                                     ::3::\n<\/p><\/blockquote>\n<blockquote><p>                    distinguishing the case of <a href=\"\/doc\/1531171\/\">Harinagar Sugar Mills Ltd. v.<br \/>\n                    Shyam Sunder Jhunjhunwala<\/a> where the Central<br \/>\n                    Government      reversed   the   decision      of   the   State<br \/>\n                    Government without giving reasons for reversal, this<br \/>\n                    Court pointed out that there was a vital difference<br \/>\n                    between the order of reversal by the appellate authority<br \/>\n                    and the order of affirmance by the revising authority and<br \/>\n                    that if the revising authority rejects a revision application<br \/>\n                    stating that there was no valid ground for interference<br \/>\n                    with the order of the subordinate authority in such a case,<br \/>\n                    it could not be held that the order was arbitrary or that<br \/>\n                    there was no trial of the revision application. Subba Rao,<br \/>\n                    J. ( as he then was) speaking for himself in that case<br \/>\n                    observed:\n<\/p><\/blockquote>\n<blockquote><p>                           Ordinarily, the appellate or revisional tribunal shall<br \/>\n                    give its own reasons succinctly; but in a case of<br \/>\n                    affirmance where the original tribunal gives adequate<br \/>\n                    reasons, the appellate tribunal may dismiss the appeal or<br \/>\n                    the revision, as the case may be, agreeing with those<br \/>\n                    reasons.&#8221;<\/p><\/blockquote>\n<blockquote><p>             <a href=\"\/doc\/400596\/\">In S. N. Mukherjee v. Union of India<\/a> reported as (1990) 4<\/p>\n<p>SCC 594 the Apex Court held as follows:-\n<\/p><\/blockquote>\n<blockquote><p>                    &#8220;The need for recording of reasons is greater in a case<br \/>\n                    where the order is passed at the original stage.           The<br \/>\n                    appellate or revisional authority, if it affirms such an<br \/>\n                    order, need not give separate reasons if the appellate or<br \/>\n                    revisional authority agrees with the reasons contained in<br \/>\n                    the order under challenge.&#8221;<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>             A perusal of the impugned order reveals that the revisional<\/p>\n<p>Authority has applied its mind to all the relevant considerations. In view of<\/p>\n<p>the decisions of the Hon&#8217;ble Supreme Court mentioned above it cannot be<\/p>\n<p>held that the order is illegal.\n<\/p><\/blockquote>\n<p> C.W.P No. 2372 of 2009                                  ::4::<\/p>\n<p>             Consequently, this writ petition is dismissed in limine with no<\/p>\n<p>order as to costs.\n<\/p>\n<pre>                                        ( AJAY TEWARI           )\nFebruary     13, 2009.
