The alleged offences are under Sections 55 (a) and 55 (g)<\/p>\n<p>of the Abkari Act. According to prosecution, petitioner transported<\/p>\n<p>5074 litres of spirit in his lorry on 23.02.2010. The lorry was<\/p>\n<p>found parked near the godown of a company at Angamally.<\/p>\n<p>Petitioner was arrested on 22.03.2010.<\/p>\n<p>      3. Petitioner is in custody for the past 74 days. Charge sheet<\/p>\n<p>is laid on 30.03.2010. It is submitted by the learned counsel for<\/p>\n<p>petitioner that petitioner is not the R.C. Owner. He was arrested<\/p>\n<p>on the statement given by CW5, who is the registered owner of<\/p>\n<p>the lorry that the lorry involved int his case was sold to the<\/p>\n<p>petitioner, on the strength of an agreement.<\/p>\n<p>      4. This petition is not opposed, since charge sheet is already<\/p>\n<p>laid, but stringent conditions may be imposed, it is submitted.<\/p>\n<p>      5. On hearing both sides, I am satisfied that bail can be<\/p>\n<p>granted on conditions. Hence the following order is passed:<\/p>\n<p><span class=\"hidden_text\">B.A. No.3439 of 2010                2<\/span><\/p>\n<blockquote><p>                   Petitioner shall be released on bail on his<\/p>\n<p>          executing a bond           for Rs.1,00,000\/- with two<\/p>\n<p>          solvent sureties each for the like sum to the<\/p>\n<p>          satisfaction of the Magistrate Court concerned on<\/p>\n<p>          the following conditions:<\/p>\n<blockquote><p>                 i)    Petitioner   shall     report   before    the<br \/>\n                       Investigating     Officer   on   every    day<br \/>\n                       between 10 A.M. and 1 P.M., until further<br \/>\n                       orders.\n<\/p><\/blockquote>\n<blockquote><p>                 ii)     Petitioner shall not leave the limits of the<br \/>\n                       police station within which the crime is<br \/>\n                       registered, except with prior permission of<br \/>\n                       the learned Magistrate.\n<\/p><\/blockquote>\n<blockquote><p>                 iii)   Petitioner shall not influence or intimidate<br \/>\n                       any witness or tamper with the evidence.\n<\/p><\/blockquote>\n<blockquote><p>                 iv) In case, petitioner is involved in any similar<br \/>\n                       offence, bail is liable to be cancelled.\n<\/p><\/blockquote>\n<\/blockquote>\n<p>         This petition is allowed.<\/p>\n<p>                                              K.
