Justice M.C.HARI RANI\n\n Dated :11\/11\/2010\n\n O R D E R\n              K.M.JOSEPH &amp; M.C.HARI RANI, JJ.\n        ------------------------------------------------------\n                W.P.(C) No.33724 of 2010-M\n           ----------------------------------------------\n         Dated, this the 11th day of November, 2010\n\n                         J U D G M E N T\n<\/pre>\n<p>K.M.Joseph, J.\n<\/p>\n<p>            Petitioner has approached this Court seeking the<\/p>\n<p>following reliefs:\n<\/p>\n<blockquote><p>     &#8220;i) to issue a writ of mandamus commanding the<\/p>\n<p>     respondents 1 to 3 to provide adequate and sufficient<\/p>\n<p>     police protection for the General Body meeting of the<\/p>\n<p>     Thattamala Muslim Jama-Ath Committee represented by<\/p>\n<p>     the petitioner which is scheduled on 12.11.2010 and<\/p>\n<p>     ensure peace, law and order in the locality.<\/p>\n<\/blockquote>\n<blockquote><p>     ii) to issue a writ of mandamus directing the Ist<\/p>\n<p>     respondent   to   take  appropriate    action on    Ext.P2<\/p>\n<p>     submitted by the petitioner in accordance with law and<\/p>\n<p>     see that no law and order situation is created in the<\/p>\n<p>     area.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>            2.   Briefly put, the case of the petitioner is as<\/p>\n<p>follows: Petitioner is the Secretary of Thattamala Jama-Ath, a<\/p>\n<p>registered organisation. There are complaints against the 9th<\/p>\n<p>respondent.     Removal of 9th     respondent      is sought.  The<\/p>\n<p>General Body was scheduled to be held on 5.11.2010 as<\/p>\n<p>notified by the petitioner. Petitioner sought police protection<\/p>\n<p>before the    2nd respondent vide Ext.P1.        The meeting was<\/p>\n<p>convened on 5.11.2010. But, since respondents 2 and 3 had<\/p>\n<p><span class=\"hidden_text\">WPC No.33724\/2010                     -2-<\/span><\/p>\n<p>not provided any safeguards, respondents 4 to 8 at the<\/p>\n<p>instance of the 9th respondent brought some outside antisocial<\/p>\n<p>elements inside the meeting hall and created a fearsome<\/p>\n<p>atmosphere there. The General Body is now proposed to be<\/p>\n<p>held on 12.11.2010. Petitioner filed representation seeking<\/p>\n<p>protection.<\/p><\/blockquote>\n<p>             3.    A counter affidavit is filed by the party<\/p>\n<p>respondents. In the counter affidavit it is inter alia stated that<\/p>\n<p>order of injunction has been granted by the civil Court against<\/p>\n<p>removal of any staff for ten days.\n<\/p>\n<p>             4.    We heard the learned counsel for the<\/p>\n<p>petitioner, learned counsel for the party respondents and also<\/p>\n<p>the learned Government Pleader.\n<\/p>\n<p>             5. Of course, it is true that the 5th respondent is<\/p>\n<p>one of the plaintiffs and the petitioner at whose instance the<\/p>\n<p>interim injunction is granted. It is pointed out that the order is<\/p>\n<p>obtained after the filing of the writ petition and notice is<\/p>\n<p>received. Learned counsel for the party respondents points<\/p>\n<p>out that the suit is filed on 10.11.2010 and there are other<\/p>\n<p>plaintiffs apart from the 5th respondent in the suit. The fact of<\/p>\n<p>the matter is now there is an order of injunction passed by the<\/p>\n<p>civil Court for ten days. Learned counsel for the petitioner<\/p>\n<p><span class=\"hidden_text\">WPC No.33724\/2010                      -3-<\/span><\/p>\n<p>would point out that the injunction is only against removal and<\/p>\n<p>meeting can go on. He would also submit that 300 members<\/p>\n<p>requisitioned urgent meeting and there will be law and order<\/p>\n<p>situation. We would not think that it will be a proper exercise<\/p>\n<p>of jurisdiction to grant relief.\n<\/p>\n<p>             6 . Learned Government Pleader would submit that<\/p>\n<p>there are disputes between the parties and police have made<\/p>\n<p>necessary arrangements to avoid the law and order situation.<\/p>\n<p>             7. We do not think that the petitioner has made<\/p>\n<p>out a case for granting protection in exercise of our extra<\/p>\n<p>ordinary jurisdiction in the circumstances of the case.
