This Appeal preferred under Clause 10 of the<br \/>\n                      Letters Patent arises from the judgment and order dated<br \/>\n                      21st January, 2011 passed by the learned single Judge in<br \/>\n                      above CWJC No. 1263 of 2011.\n<\/p>\n<p>                                 The petitioner, an Assistant in the respondent<br \/>\n                      Bihar State Co-operative Land Development Bank Ltd.\n<\/p>\n<p><span class=\"hidden_text\">                  2<\/span><\/p>\n<p>(hereinafter referred to as &#8216;the Bank&#8217;), appointed on<br \/>\nconsolidated pay, has been transferred from Hazipur to<br \/>\nNavinagar in Aurangabad District. The said order of<br \/>\ntransfer made on 3rd January 2011 was challenged by the<br \/>\npetitioner-appellant in above C.W.J.C. No. 1263 of 2011.<br \/>\nThe challenge was on the ground of mala fide.\n<\/p>\n<p>          Learned single Judge did not believe the<br \/>\nallegation of mala fide. It has been observed that due to<br \/>\npaucity of staff the Bank had transferred as many as 12<br \/>\nAssistants\/Accountants at different places including the<br \/>\npetitioner at Navinagar. In view of the said findings the<br \/>\nlearned single Judge has dismissed the writ petition.<br \/>\nTherefore, the present Appeal.\n<\/p>\n<p>          Learned Advocate Mr. Tandon has appeared for<br \/>\nthe appellant. He has submitted that the appellant was not<br \/>\npaid the wages for certain period in the year 2006. So in<br \/>\nview of the wages due, the appellant could not have been<br \/>\ntransferred. The order of transfer is, therefore, vitiated by<br \/>\nmala fide. Mr. Tandon has relied upon the judgment of this<br \/>\ncourt in the matter of Chandramauli Agrawal Vs. State of<br \/>\nBihar &amp; Ors. [2009(2) PLJR 525]. He has submitted that so<br \/>\nlong as the wages are outstanding, a servant cannot be<br \/>\ntransferred.\n<\/p>\n<p>          We see no substance in this submission. In the<br \/>\naforesaid matter this court had observed that the<br \/>\nrespondent-Corporation had closed down. So it was unable<br \/>\nto pay wages to some employees for a long time and was<br \/>\nalso unable to provide residence to its employees.\n<\/p>\n<p>          In respect of monthly salary prior to 2006, the<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>        appellant had approached this court in C.W.J.C. No. 2866<br \/>\n        of 2009. The learned single Judge vide order dated 19th<br \/>\n        August 2009 directed the appellant to make a detailed<br \/>\n        representation before the Managing Director of the Bank<br \/>\n        and the Managing Director was directed to dispose of the<br \/>\n        representation of the appellant within the specified time.\n<\/p>\n<p>                  Mr. Tandon has also submitted that several other<br \/>\n        employees, who were serving in the Bank continuously<br \/>\n        since the year 2000 have not been transferred. In our view,<br \/>\n        the rule of equality contained in Articles 14 and 16 of the<br \/>\n        Constitution does not apply in the matter of transfers.\n<\/p>\n<p>                  No case for interference is made out. The Appeal<br \/>\n        is dismissed in limine.\n<\/p>\n<p>                  The interlocutory application stands disposed of.<br \/>\n                  At this stage Mr. Tandon submits that the<br \/>\n        appellant be allowed to remain at the place for a period of<br \/>\n        one month. In case the appellant has personal difficulty he<br \/>\n        may approach the Bank for such indulgence.\n<\/p>\n<p>                                  (R.M.
