The applicant has no criminal antecedents. He<br \/>\nis in jail since 10.9.2010.\n<\/p>\n<p> \tIn<br \/>\naddition to above, I have also perused the evidence collected by the<br \/>\ninvestigating agency with assistance of learned APP. Since trial is<br \/>\nyet to be conducted, it would not be appropriate on my part to make<br \/>\nconclusive remarks on the nature of record. However, it prima facie<br \/>\nappears that &#8216;Dharya&#8217; was recovered from the applicant. FSL report<br \/>\ndoes not indicate bloodstains on the same. This and other attendant<br \/>\ncircumstances noted above would convince me to release the present<br \/>\napplicant on bail on certain conditions.\n<\/p>\n<p>\tUnder<br \/>\nthe circumstances, the applicant is ordered to be released on bail in<br \/>\nconnection with C.R. No. I-182\/2010 registered before Mahemdavad<br \/>\npolice station, Kheda,  on his furnishing bond of Rs. 20,000\/-(Rupees<br \/>\nTwenty Thousand) with one surety of like amount to the satisfaction<br \/>\nof the lower Court and subject to following conditions that he shall:\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>maintain<br \/>\n\tlaw and order;\n<\/p>\n<p>mark<br \/>\n\this presence before the Mahemdavad Police Station, Kheda on every<br \/>\n\t1st and 15th day of English Calendar month<br \/>\n\tbetween 11:00 am to 2:00 pm:\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>furnish<br \/>\n\tthe address of his residence at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of  this<br \/>\n\tCourt;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the Lower Court immediately.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed,  the Sessions<br \/>\nJudge concerned will be free  to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>\tRule<br \/>\nis made absolute.
