In his response of 12.02.2008 the CPIO Shri V. K. Agrawal, Under<br \/>\nSecretary, SSC, New Delhi provided information to the appellant. The appellant<br \/>\nShri Kamdev Paswan, finding the response unsatisfactory, moved another<br \/>\napplication dated 07.03.2008 reiterating his request. But no response was<br \/>\nreceived against the second application. Consequently, the appellant on<br \/>\n15.05.2008 approached the first appeal authority under section 19(1) of the RTI<br \/>\nAct. The appellant has filed this appeal before us alleging that the appellate<br \/>\nauthority did not pass any order in respect of the appeal filed.\n<\/p>\n<p>       Because the 1st appellate authority has not addressed the questions of<br \/>\nappellant, which are of direct concern to her public authority, the Commission<br \/>\nhas decided to remand this appeal to Appellate Authority Ms. Gayatri Sharma,<br \/>\nDeputy Secretary, SSC, to dispose of the appeal of Shri Kamdev Paswan<\/p>\n<p><span class=\"hidden_text\">                                          1<\/span><br \/>\n within ten working days from the date of receipt of this decision, under<br \/>\nintimation to Shri Pankaj Shreyaskar, Jt Registrar, Central Information<br \/>\nCommission.\n<\/p>\n<p>      Appellate Authority Ms. Gayatri Sharma will also satisfy herself on the<br \/>\nissue of failure of CPIO to respond to the second RTI application dated<br \/>\n07.03.2008 of appellant Shri Kamdev Paswan and if so required approach this<br \/>\nCommission for initiation of proceedings under section 20 of the RTI Act for<br \/>\nimposition of penalty and\/ or recommending appropriate disciplinary action.\n<\/p>\n<p>     If not satisfied with the information provided on his 1st appeal, appellant Shri<br \/>\nKamdev Paswan will be free to move a 2nd appeal before us as per Sec 19 (3).\n<\/p>\n<p>        Announced.
