No.13809 of 2011\n                                      Rakesh Singh\n                                           Versus\n                                   The State Of Bihar\n                                         -----------\n<\/pre>\n<p>2   30.06.2011              Heard learned counsel for the petitioner as well<\/p>\n<p>                 as learned Additional Public Prosecutor for the state.<\/p>\n<p>                            The petitioner is said to be rapist of a minor girl,<\/p>\n<p>                 aged about 9-10 years.\n<\/p>\n<p>                            The contention of learned counsel for the<\/p>\n<p>                 petitioner is that the petitioner has falsely been implicated in<\/p>\n<p>                 this case by the informant and as a matter of fact, no such<\/p>\n<p>                 occurrence did ever take place. It is contended by him that<\/p>\n<p>                 the fardbeyan of the informant was recorded on 29.10.2010<\/p>\n<p>                 whereas, the occurrence is said to be taken place on<\/p>\n<p>                 25.10.2010 and no explanation of the aforesaid delay, has<\/p>\n<p>                 been given. It is further contended by him that several co-<\/p>\n<p>                 villagers submitted a written report before the DIG, Saran<\/p>\n<p>                 Range, Chapra disclosing the real fact and furthermore,<\/p>\n<p>                 when the victim girl was medically examined on 02.11.2010,<\/p>\n<p>                 no sign of intercourse was found on her person and<\/p>\n<p>                 furthermore, the prosecution has not given explanation for<\/p>\n<p>                 delay in examination of the victim girl.\n<\/p>\n<p>                            Although learned counsel for the petitioner tried<\/p>\n<p>                 to convince me about the innocence of the petitioner but I<\/p>\n<p>                 am not, at all, convinced with his submission. Admittedly, the<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>        victim girl has narrated the entire episode in her statement<\/p>\n<p>        recorded under section-164 of the Cr.P.C. Therefore,<\/p>\n<p>        considering the nature of alleged offence as well as<\/p>\n<p>        submission of the parties, the prayer for bail of the petitioner<\/p>\n<p>        in connection with Garkha P.S.
