This appeal under Section 19 of the Consumer Protection Act, is barred by 472 days.  According to Mr. M. Wadhwani, learned counsel for the appellant, there is no delay. A great deal of controversy has been raised as to the change in the records of the State Commission. First controversy is if in the complaint whether there were two  complaints or only one. Copy of the complaint when served on the opposite party showed there were two complainants-(i) Justice B.C. Basak and (ii) Mrs. Gargi Basak, wife of Justice B.C. Basak. Mr. Wadhwani says when he saw the record in the State Commission name of Mrs. Gargi Basak had been scored out. As to who did it nobody knows. Complaint was about deficiency in service being rendered to Justice B.C.Basak and his wife. They were to travel from Honkong to Calcutta via Bangkok. on the opposite party airlines. Mr. Wadhwani states that complaint was that when the  plane took off from Hongkon airport the pilot felt some trouble in the aircraft and he brought back the aircraft to Hongkong. After some time the plan again took off. Complaint was that during the period when Justice B.C. Basak and his  wife were stranded at Honkong airport no proper services were rendered to them. Be that as it may, after filing of the complaint Justice Basak died on 5.12.97. Now the second controversy is as to how the name of Mrs. Gargi Basak was substituted when her name stood deleted in the complaint. Grievance is that President of the State Commission of his own changed the order and, in effect there was no order passed substituting the name of Mrs. Gargi Basak vice her deceased husband and the matter was adjourned to 4.6.98. This order is of the date of 24.4.98. Opposite party filed a petition for recalling of this order. Order on this was made by the State Commission comprising President and two Members on 19.4.2000. It would be appropriate to quote this order in extenso:\n<\/p>\n<p>&#8220;Both sides are present through their counsels. The Ld. Counsel for the Respondent submits that the order of this Commission dated 24.4.98 is illegal on the ground that some typed out portion of the order was penned through and the name of Smt. Gargi Basak was ordered to be substituted in place of her husband, Justice Basak who expired on 5.12.97. He submits that this order be recalled and Smt. Gargi Basak cannot be allowed to proceed with this litigation. Mr. Prasanta Banerjee, Advocate appearing for the Petitioner submits that he was not the recorded Lawyer when the order dt. 24.4.98 came out. We examined the order and it appears that some portion of the order was written by hand presumably under the hand of the ten President of the Commission. An examination of the writing in hand even in naked eye would disclose that it was in the handwriting of the then President. This order demonstrates that on the prayer of Smt. Gargi Basak, the name of her husband Justice Basak was deleted and Smt. Gargi Basak was allowed to be substituted in place of her husband Therefore, it seems that the suspicion of the Ld. Counsel for the OP about adoption of some unfair practice unfounded. The OP does not come with an Affidavit raising objection regarding some manipulation in the order passed. So we have no hesitation to reject the submission made by the Ld. Counsel for the OP. The order was passed way back on 24.4.98 and it was allowed to continue till today. Considering all the aspects of the matter we reject the submission made by the Ld. Counsel for the OP.\n<\/p>\n<p>The matter is then taken up for final hearing. Parties, are directed to come ready for final hearing.\n<\/p>\n<p>The Ld. Counsel for the OP wants to cross-examine the claimant Smt. Gargi Basak. OPs are directed to specify the points on which they want to cross-examine the present claim claimant by 10th May of 2000. The application should be supported by an Affidavit when the matter will be heard and considered and necessary order passed&#8221;\n<\/p>\n<p>2. This order is applicable under Section 19 of the Consumer Protection Act. No appeal was filed. Instead opposite party filed Writ Petition in the Calcutta High  Court on 8.5.2001. This petition in the High Court was dismissed on 6.7.2001. Thereafter, present appeal came to be filed on 4.9.2001.  Contention of Mr. Wadhwani that since opposite party was pursuing the matter bona fide in the Calcutta High Court, time spent in disposing of Writ Petition should be excluded. We are unable to agree with this proposition. It is not disputed that the order dated 19.4.2000 is appealable order. One does not have to go to High Court to be told that appeal lies against the impugned order of the State Commission to the National Commission. First order dated 24.4.98 by which it is alleged that Mr.s Gargi Basak was wrongly impleaded will itself be appealable. We are not inclined to allow the time spent for getting this order reviewed and final order culminating on 19.4.2000.\n<\/p>\n<p>3. More over, matter is yet to be decided on merit. We should not be interfering with the interim order howsoever strong a party may feel. As to what is the effect of making the order dated 24.4.1998 substituting the name of Mrs. Gargi Basak has been considered by all the Members of the State Commission and they have not thought it fit to disturb the same. As a matter of fact controversy regarding substituting the name of wife of the deceased should not have raised after the order dated 19.4.2000 of the State Commission. In the circumstances, were are not inclined to condone the delay, particularly the impugned order does not affect the merit of the case.
