Letters Patent Appeal No. 1061 of 2011.\n<\/p>\n<p>                             This appeal under Clause 10 of the Letters Patent is<br \/>\n             preferred by the writ petitioners against the judgment and order<br \/>\n             dated 3rd May 2011 passed by the learned single Judge in above<br \/>\n             CWJC No. 5032 of 2005.\n<\/p>\n<p>                             The appellants are two of the applicants who, in<br \/>\n             answer to the advertisement issued by the Bihar Public Service<br \/>\n             Commission, applied for selection and appointment to the<br \/>\n             administrative posts in the then State of Bihar (prior to its<br \/>\n             bifurcation into the State of Bihar and the State of Jharkhand) in<br \/>\n             the reserved category of Scheduled Tribes. The petitioners took the<br \/>\n             43rd to 52nd Combined Competitive Examination conducted by the<br \/>\n             Bihar Public Service Commission but have not succeeded. Process<br \/>\n             of recruitment was intervened by an unforeseen incident of<br \/>\n             bifurcation of the then State of Bihar into the States of Bihar and<br \/>\n             Jharkhand under the Bihar State Re-organization Act, 2000. On<br \/>\n             account of the bifurcation of the State, the vacancy position was<br \/>\n             substantially altered. The reservation for Scheduled Tribes also<br \/>\n             stood altered on account of most of the tribal areas being part of<br \/>\n             the State of Jharkhand.\n<\/p>\n<p>                             It is the grievance of the appellants that but for the<br \/>\n             reduction in the extent of reservation for the Scheduled Tribes<br \/>\n             under the Bihar Reservation of Vacancies in the Post and Services<br \/>\n             (For Backward Castes, Scheduled Tribes and Other Backward<br \/>\n             Classes) Amendment Act, 2002 (Bihar Act 17 of 2002)<br \/>\n             [hereinafter referred to as the `2002 Act&#8217;] the appellants would<br \/>\n             have been selected for appointment to the posts reserved for<br \/>\n             Scheduled Tribes.\n<\/p>\n<p>                             The appellants approached this Court in above CWJC<br \/>\n<span class=\"hidden_text\"> 3   Patna High Court LPA No.1061 of 2011 (2) dt.25-07-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                          3\/4<\/span><\/p>\n<p>             No. 5032 of 2005 to assert that the respondents should make<br \/>\n             appointment to the declared vacancies and, for the reservation for<br \/>\n             Scheduled Tribe candidates, rules as were prevalent prior to the<br \/>\n             2002 Act should be followed. The claim has been rejected by the<br \/>\n             learned single Judge. The learned single Judge has held, &#8220;There<br \/>\n             are two reasons for it, efflux of time and another is the change<br \/>\n             in demographical scenario in the bifurcated State of Bihar as<br \/>\n             well as the date of publication of final result and appointment,<br \/>\n             which have already been made after bifurcation of the State of<br \/>\n             Bihar. The reliance placed by the petitioners&#8217; Counsel on an<br \/>\n             unreported Division Bench decision of this Court in C.W.J.C.<br \/>\n             No. 2563 of 2003 has no application in the present case,<br \/>\n             considering the difference in the facts of both the cases.&#8221;\n<\/p>\n<p>                             Feeling aggrieved, the petitioners have preferred the<br \/>\n             present appeal. Learned Advocate Mr. Vivek Prasad has appeared<br \/>\n             for the appellants. He has submitted that it is the settled law that<br \/>\n             once the recruitment process is commenced, the same shall be<br \/>\n             completed in accordance with the rules prevalent at the time of the<br \/>\n             commencement of the recruitment process. In the present case, the<br \/>\n             recruitment process was intervened by the aforesaid Re-<br \/>\n             organization Act, 2000 and the 2002 Act. The State of Bihar and<br \/>\n             the Bihar Public Service Commission wrongly regulated the<br \/>\n             recruitment process by the aforesaid provisions instead of<br \/>\n             continuing under the provisions prevalent at the time of<br \/>\n             commencement of the recruitment process. In support thereof he<br \/>\n             has relied upon the judgments of the Hon&#8217;ble Supreme Court in<br \/>\n             the matters of <a href=\"\/doc\/872416\/\">A.A. Calton v. The Director of Education &amp; Anr.<\/a><br \/>\n             [AIR 1983 SC 1143] and of P. Mahendran &amp; Ors. v. Matteesh Y.<br \/>\n             Annigeri &amp; Ors. [AIR 1990 SC 405].\n<\/p>\n<p><span class=\"hidden_text\"> 4            Patna High Court LPA No.1061 of 2011 (2) dt.25-07-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                                   4\/4<\/span><\/p>\n<p>                                      We do agree with the proposition of law enunciated in<br \/>\n                      the aforesaid judgments and reiterated time and again. We do also<br \/>\n                      agree with the learned single Judge that the passage of time and<br \/>\n                      the intervening incidence of bifurcation of the then State of Bihar<br \/>\n                      have to be considered before following the aforesaid settled law.<br \/>\n                      The aforesaid normal rule cannot be operated in the changed<br \/>\n                      scenario. We agree with the view of the learned single Judge.\n<\/p>\n<p>                                      The Appeal is dismissed.
