Commissioner under Sec.5 of the Karnataka Scheduled<\/p>\n
Caste and Scheduled Tribe [Prohibition for Transfer-.vof<\/p>\n
Certain Lands] Act, 1978 [hereinafter referred:  C <\/p>\n
for short) and has confirmed the~\u00a3)rdeI”.pass.ed”‘by:\u00bbpVt}:eif<\/p>\n
second respondent dt. 6.1.2009};  ‘ <\/p>\n
2. The third respondeVrit:’he’reinh ‘filed. application
\nbefore the Assistant.’  –‘._1’arikere Sub-
\nDivision,  seeking for
\ndeclaration’that””‘the:  in favour of the Writ
\npetitioner’ void as the land was
\ngranted.   belonging to scheduled<\/p>\n
caste. and Chasivbeen alienated on 4.11.1998 i.e., after the<\/p>\n
‘C it  into forcetff The Assistant Commissioner after<\/p>\n
“th.eV:’_iappeI1ant and third respondent herein<\/p>\n
held that thiefalienation in favour of the appellant which<\/p>\n
 Vi after— coming into force of the Act w.e.f. 1.1.1979.<\/p>\n
  “Section 4(2) of the Act reads as follows :<\/p>\n
\u00a7x..\u00a7~ <\/p>\n
!<\/p>\n
“No persons shall, after the commencement of<\/p>\n
this Act, transfer or acquire by transfer <\/p>\n
granted land Without the previous permissions’  ” <\/p>\n
of the Government.”\n<\/p>\n
Since the grant had been rnadeigingp faVc:'{1r’of_’: A”<\/p>\n
belonging to scheduled caste  aliieiiation <\/p>\n
the appellant herein was”s_tib.seqtient -iinto’-A’<\/p>\n
force of the Act without obt_atining”–.prior ” permission as
\nrequired under Sec.-4(l2}’lA’of  application for
\ndeclaring thatthe aliienlatiori  restoration of
\nthe lari’dd’to”thfe_vatgl\u00e9llicarzt”wasdallowed and the same was
\ncon\ufb01rmed ~ by’  Commissioner. Being<\/p>\n
aggrieved .ftheWrit Petition was filed. The<\/p>\n
 Single ‘Jiidge after hearing the counsel<\/p>\n
  parties held that as the alienation is<\/p>\n
s1i1′)Seq1_1ent.:’~”to coming into force of the Act. Admittedly,<\/p>\n
 pnnop permission is obtained, the alienation is void and the<\/p>\n
._d’o_rd’ei’: passed by the respondent is justified and<\/p>\n
 “accordingly dismissed the Writ Petition. Being<\/p>\n

aggrieved by the said order of the learned Single Judge<\/p>\n
