No.24211 of 2011\n                  Shambhu Mandal, Son of Bhagat Mandal, resident of Village-Pholkia Akoshi\n                  Tola, P.S.-Ghogha, District-Bhagalpur.            .............Petitioner.\n                                           Versus\n                  The State of Bihar                                .......Opp. Party.\n                                          -----------\n<\/pre>\n<p>2.   22.07.2011                    Heard learned counsel for the petitioner and<\/p>\n<p>                        learned counsel appearing for the State.<\/p>\n<p>                                   The petitioner apprehends arrest in connection<\/p>\n<p>                        with a case registered for the offence under sections 384,<\/p>\n<p>                        364 and 34 of the Indian Penal Code.\n<\/p>\n<p>                                   In the F.I.R. altogether 18 persons including the<\/p>\n<p>                        petitioner have been named whereas 10-12 unknown<\/p>\n<p>                        persons are also alleged to have participated in the<\/p>\n<p>                        occurrence. It is alleged that the accused persons being<\/p>\n<p>                        variously armed with deadly weapons, ordered the<\/p>\n<p>                        informant and his companions who are fishermen to come<\/p>\n<p>                        near the bank of the river when they came at the bank of<\/p>\n<p>                        the river, the accused persons asked as to why they did<\/p>\n<p>                        not give Rs. 500\/- and 25 Kg. rice per boat. Thereafter,<\/p>\n<p>                        the accused persons tried to take away the informant and<\/p>\n<p>                        others towards Bhajaiya Baihar, in the meantime, the<\/p>\n<p>                        accused persons fled away as they noticed that police<\/p>\n<p>                        personnel were coming on two boats.\n<\/p>\n<p>                                   Learned counsel for the petitioner submits that<\/p>\n<p>                        the present case has been instituted with oblique motive<\/p>\n<p>                        due to dirty village politics. There is no specific allegation<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>          against the petitioner. The allegations are general and<\/p>\n<p>          omnibus in nature. No offence under Section 384 IPC and<\/p>\n<p>          \/ or under Section 364 IPC would be attracted in the facts<\/p>\n<p>          and circumstances of the case.\n<\/p>\n<p>                    It has also been submitted that petitioner has<\/p>\n<p>          got no criminal antecedent, which fact should be verified<\/p>\n<p>          by the court below.\n<\/p>\n<p>                    Learned counsel for the State opposes the<\/p>\n<p>          prayer for grant of bail.\n<\/p>\n<p>                    Taking       into   consideration   the    aforesaid<\/p>\n<p>          submission let the petitioner, namely, Shambhu Mandal<\/p>\n<p>          in the event of his arrest or surrender before the Court<\/p>\n<p>          below within a period of four weeks from the date of<\/p>\n<p>          communication of this order, be released on provisional<\/p>\n<p>          bail on furnishing bail bond of Rs. 5,000\/- (Five<\/p>\n<p>          thousand) with two sureties of the like amount each to<\/p>\n<p>          the satisfaction of A.C.J.M., Naugachia in connection with<\/p>\n<p>          Gopalpur P.S. Case No. 152 of 2001 and the provisional<\/p>\n<p>          bail so granted should be confirmed only after receipt of<\/p>\n<p>          report regarding criminal antecedent of the petitioner.
